But the point is that the legislature is giving <br />serious consideration to the establishment of a wild and scenic rivers <br />system within the state of Colorado. <br /> <br />Mr. Ford: But we certainly don't want to set a principle here because <br />we are going to be confronted with these things in the future too. <br /> <br />Mr. Moses: My feeling on it is that this is a good opportunity to <br />establiph some precedent. If we take positive action here, then perhaps <br />we woul9 have an opportunity to take positive action in a situation <br />where we think it will be detrimental. <br /> <br />Mr. Vandemoer: Mr. Chairman, I have one more question. <br /> <br />Mr. Stapleton: Yes. <br /> <br />Mr. Vandemoer: Is there anything, Ray, in the overall wild and scenic <br />rivers bill, is there anything in there as far as salinity and future <br />pollution in these areas? Would it be a responsibility or the state to <br />maintain a certain water quality in the designated areas? <br /> <br />Mr. Moses: I think that is adequately covered in other federal legis- <br />lation. <br /> <br />Mr. Sparks: It is not in this act. It is in that act which gives the <br />Environmental Protection Agency the authority to control salinity. That <br />authority exists independently of the wild and scenic rivers act. <br /> <br />Mr. Vandemoer: I notice this one, Larry, says wild rivers are waters <br />unpolluted. That could cover a lot of things. I think and maybe I am <br />wrong, nOW you are thinking of this as a scenic river area. It doesn't <br />say anything about pollution in that area, is that right? <br /> <br />Mr. Sparks: No. <br /> <br />Mr. Vandemoer: Am I reading this wrong? <br /> <br />Mr. Sparks: The upper area where the canyon starts just below Loma, it <br />appears to us, would qualify as a wild river area. There are no roads <br />or anyth:ing in that, area. On the lower section, the Ruby Canyon, this <br />would probably qualify as a scenic river' area becuase it is traversed <br />by the D&RGW Railroad - scenic or recreational, either one. <br /> <br />-12- <br /> <br />I <br /> <br />I <br />
