MR. SPARKS:

"Gentlemen at our last Board meeting
there was presented to us a suggested plan
on the Cherry Creek Dam with reference to a
conservation pool of some ten thousand acre
feet. We were requested to approve that
project and to make recommendations at that
time.

I

You will recall that several of the
Board members stated it would be advisable,
and they thought necessary to request suggest-
ions from, or appearance before this Board, of
interested water users before the Board could
make any recommendation as to the operational
procedure of Cherry Creek Dam.

At that time.it was suggested that we
have this meeting here in Durango so it was
not practical to call people from that area
to this Board meeting. Frankly, gentlemen,
it is, in my opinion, wrong to call those water
users before this Board. If this Board is
going to assume jurisdiction of purely adminis-
trative matters concerning water rights, not
involving interstate controversy, then we, have
usurped the duties of the State Engineer's office.
I feel we can accomplish nothing in connection
with the Cherry Creek Dam Proposal since we have
nothing to do with it's operation, nothing what-
soever. Any decision that we made would be a
useless gesture.

It is therefore, my recommendation that
we inform the Governor that this Board has
nothing to do with the operational procedure of
Chery Creek Dam and that we drop the matter at
that point."

MR. CHRISTY:

"You are speaking of this one project only?
You would not take the same position in connec-
tion with John Martin which is involved in inter-
state?"

MR. MOSES:

"Since 1 called on Larry, I have been hand-
ed letters from the following: City of Aurora,
City of Englewood, Henrylyn Irrigation District,
City of Littleton and the Consolidated Ditches
Company, Water District No. Two."

Mr. Moses read the foregoing letters in their entirety.
