<br />606 <br /> <br />I <br /> <br />present time. Through the years I have <br />systematically gathered data from a <br />large number of wells and from these <br />data it has been possible to determine <br />the spots where pumping has been in ex- <br />cess of replacement and the water table <br />has been going down. <br /> <br />In 1945 the Government Survey car- <br />caried on a much more complete program <br />and it was much more detailed in certain <br />areas where mine was more general. I <br />feel that we have much of the basic in- <br />formation available to us for the deter- <br />mination of the basic principles of any <br />groundwater law and as has been stated <br />before, this bill for consideration at <br />the present time, is based on generali- <br />ties. It would be necessary to secure <br />any specific detailed information that <br />we do not have now but so far as geology <br />and hydrology are concerned, we have suf- <br />ficient information at this time to go <br />ahead with the type of legislation pro- <br />posed, or something similar to it. I <br />have felt personally we have been delayed <br />too long in doing something about it. It <br />would have been a much simpler thing if <br />this had been taken up 15 or 20 years ago <br />in places where sore spots have developed. <br />These have all developed since about 1945 <br />or along in there; they are all the same <br />but it does seem necessary to protect <br />those people in those areas with some <br />kind of legislation now." <br /> <br />MR. MOSES: <br /> <br />"Thank you, Mr. Code. Is there any- <br />one else?" <br /> <br />I <br /> <br />Mr. Fischer from the Union Oil Company asked ques- <br />tions regarding the proposed legislation in regard to the <br />oil industry. Mr. Kelly, Mr. Miller and Mr. Sabin further <br />discussed the question of the adoption of the resolution in <br />its original form. Mr. Duane Barnard asked if the Board was <br />going to support the proposed bill presented by the Farm Bur- <br />eau and Mr. Moses explained again that the only question <br />before the Board was whether or not the resolution was to be <br />adopted. Mr. John Barnard Sr. spoke and Mr. John Barnard Jr. <br />brought up the question as to whether the resolution did not <br />definitely propose that the Board ask that legislation be <br />deferred at this time. <br />
