NO. 157 <br /> <br />COLORADO WATER CONSERVATION BOARD <br />823 state Centennial Building <br />1313 Sherman street <br />Denver, Colorado 80203 <br /> <br />March 17, 1980 <br /> <br />R E ~ 0 L U T ~ 0 N <br /> <br />WHEREAS, the united states Army Corps of Engineers, <br />Omaha District, completed in December, 1972, a floodplain informa- <br />tion report entitled "Special Flood Hazard Information Report, <br />Bear Creek, Denver Metropolitan Area"; and <br /> <br />WHEREAS, the Colorado Water Conservation Board. by <br />resolution adopted January 18. 1973, approved and degignated the <br />floOdplains described in the December, 1972, report; and <br /> <br />WHEREAS, a new report entitled "Flood Hazard Area <br />Delineation, Bear Creek," dated December, 1979, has been prepared <br />by Gingery Associates, Inc., at the request of the urban Drainage <br />and Flood Control District, the City and County of Denver, the city <br />of Lakewood, the city of Sherid~n, and Jefferson county; and <br /> <br />WHEREAS, Bear Creek D~ and Lake is now fully operational <br />and said new report shows the r@sidual 100-year (intermediate <br />regional flood) floodplain; and <br /> <br />WHEREAS, said report aescribes and outlines the flOOdplain <br />data and information for the storm and floodwater runoff channels <br />or basins of the study area; ana <br /> <br />WHEREAS, the Urban Dr~inage and Flood Control District <br />has requested the Colorado Water Conservation Board to designate <br />and approve the floodplain areas as set fOrth in the aforesaid <br />report; and <br /> <br />WHEREAS, Section 37-60-106(1), Colorado Revised Statutes <br />1973, requires the Colorado Water Conservation Board to assist in <br />the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-201 and 30-28-111, Colorado <br />Revised Statutes 1973, provide that such legislative bOdies of <br />lOcal jurisdictions may provide zoning regulations for land uses <br />on or along any storm or floodwater runoff channel or basin only <br />after designation and approval by the Colorado Water Conservation <br />Board; and <br /> <br />WHEREAS, Section 37-60-106(1) (c), Colorado Revised <br />Statutes 1973, directs the colorado Water Conservation Board to <br />designate and approve storm or floodwater runoff channels or basins <br />and to mak@ such designations available to legislative bodies of <br />local jurisdictions; and <br />
