R E ~ 0 L U T ~ 0 N

WHEREAS, the united states Army Corps of Engineers,
Omaha District, completed in December, 1972, a floodplain informa-
tion report entitled "Special Flood Hazard Information Report,
Bear Creek, Denver Metropolitan Area"; and

WHEREAS, the Colorado Water Conservation Board. by
resolution adopted January 18. 1973, approved and degignated the
floOdplains described in the December, 1972, report; and

WHEREAS, a new report entitled "Flood Hazard Area
Delineation, Bear Creek," dated December, 1979, has been prepared
by Gingery Associates, Inc., at the request of the urban Drainage
and Flood Control District, the City and County of Denver, the city
of Lakewood, the city of Sherid~n, and Jefferson county; and

WHEREAS, Bear Creek D~ and Lake is now fully operational
and said new report shows the r@sidual 100-year (intermediate
regional flood) floodplain; and

WHEREAS, said report aescribes and outlines the flOOdplain
data and information for the storm and floodwater runoff channels
or basins of the study area; ana

WHEREAS, the Urban Dr~inage and Flood Control District
has requested the Colorado Water Conservation Board to designate
and approve the floodplain areas as set fOrth in the aforesaid
report; and

WHEREAS, Section 37-60-106(1), Colorado Revised Statutes
1973, requires the Colorado Water Conservation Board to assist in
the prevention of floods and flood damages therefrom; and

WHEREAS, Sections 31-23-201 and 30-28-111, Colorado
Revised Statutes 1973, provide that such legislative bOdies of
lOcal jurisdictions may provide zoning regulations for land uses
on or along any storm or floodwater runoff channel or basin only
after designation and approval by the Colorado Water Conservation
Board; and

WHEREAS, Section 37-60-106(1) (c), Colorado Revised
Statutes 1973, directs the colorado Water Conservation Board to
designate and approve storm or floodwater runoff channels or basins
and to mak@ such designations available to legislative bodies of
local jurisdictions; and
