<br />132 <br /> <br />Direetor Stone announced that Chris Wallrich of Denver, recently-resigned <br />member of the Board representing the San Luis Valley, had lately observed his <br />90th birthday. <br /> <br />Motion was made by Silmon Smith thAt a Resolution <br />be prepared and adopted by the Colorado Water Conservation <br />Bbard, recognizing Mr. Wallrich's 90th birthday, and that <br />a copy of the resolution be sent to Mr. Wallrich. <br /> <br />The motion was seconded by Mr. Dille. On vote. <br />being taken the motion was unanimously adopted. <br /> <br />Director Stone announced that, in accordance with Board action in an <br />executive session held the previous day on the water adjudication matter, a com- <br />mittee composed of Mr. Smith, Mr. Saunders, Mr. Dille and Mr. Breitenstein had <br />been appointed to prepare a resolution for consideration of the Colorado Water <br />Conservation Board~ <br /> <br />The text of the resolution drafted by the committee was presented by Mr. <br />Smith. The resolution is as follows: <br /> <br />"WHEREAS' the Colorado Water Conservation Board has been <br />informed by the U. S. Department of Justice and by various <br />affected interests in Colorado that a suit at the instance of <br />the United States is contemplated in the United States District <br />Court at 'Denver for accomplishing the following principal pur- <br />poses: . <br /> <br />"a. 1'0 obtain a judicial ascertainment of the. <br />status of Senate Document 80 of the 75th <br />Congress and the various rights, liabilities, <br />duties and obligations arising or to arise <br />thereunder. <br /> <br />"b. To .obtain a judieial determination in the <br />United States District Court at Denver, <br />Colorado which Will be binding on the <br />United States, of the water rights of the <br />United States arising out of its construc- <br />tion of the Colorado-Big Thompson Project <br />referred to in said Senate Document 80, <br />and to assure the binding effect of such <br />determination on the United States by an <br />action brought by the United States in its <br />own courts. <br /> <br />"c. To create the basis for incorporation in <br />decrees of appropriate state courts of <br />provisions' recognizing the rights of the <br />United States so determined in its court <br />or courts and to facilitate the orderly <br />administration of water rights in Colorado. <br /> <br />I <br /> <br />" . <br /> <br />I <br />
