<br />\ "., <br /> <br />- <br /> <br />. <br /> <br />. <br /> <br />Rod Kuharich <br />December 21,2004 <br />Page 2 <br /> <br />impacts of appropriations on (1) Colorado's ability to utilize its share of the Colorado <br />River Compact and (2) on other water uses in high usage stream segments, such as <br />Yellow Jacket Canyon Creek. <br /> <br />Cottonwood Creek presently does not have an instream flow appropriation, though one <br />was considered several years ago and not pursued. The in stream flow plan for this creek <br />is presently unknown, so the potential impacts cannot yet be specifically addressed. <br /> <br />SWCD recommends that Horsefly Creek be removed from the list for the same reasons <br />that Yellow Jacket Canyon Creek was removed, the need to address broader issues. <br /> <br />, <br />For stream segments in basins with private land, such as mining claims, please include an <br />allowance for domestic wells, even though this could be addressed by the de minimus <br />provision. <br /> <br />SWCD will have representatives at CWCB workshops and meetings which will consider <br />modifications to the instream flow program to address significant impacts to water usage, as <br />described in previous SWCD correspondence to the CWCB. <br /> <br />As always, SWCD is pleased to cooperate with the CWCB to seek water <br />development/management to meet current and future area water needs while simultaneously <br />protecting our streams to a reasonable degree. With creative thinking and cooperation, both <br />goals can be achieved.
