May 8. 19~2 <br /> <br />Call to Order (2:00 . 2:01 p.m.) <br /> <br />Vice-Chairman Martineau called the meeting back to order at 2:00 p.m. and there was <br />a quorum. Present were Harrison. Smith, Martineau, Lochhead, Sheftel, Eisel, <br />Meyring, Simpson. and Duncan. Grady McNeill, DOW, represented Peny Olson. and <br />Patricia Bangert represented Gale Norton. Absent were Salazar, Jackson. and Wright <br />Peter Evans, DNR, arrived about 2:11 p.m. 'and represented Ken Salazar. Simpson left <br />before 3:35 p.m. <br /> <br />Repon on Matters in litigation (2:01 - 2:07 p.m.) <br /> <br />Sara Duncan reported on the matters in litigation discussed in executive session during <br />lunch. In item ge, the case of Thornton v. Fort Collins, the Board considered what <br />parts of the case were remanded by a recent Supreme Court decision and what our <br />position should be. In item 9f, Snowmass Creek, the Board reviewed general legal <br />issues which have been raised, and it was felt that things that were discussed there will <br />be discussed in open session this afternoon.
