<br />Sara Duncan. Acting Director, reported on several matters including (1) a team
<br />building seminar attended by senior CWCB staff, (2) a display contest among the six
<br />CWCB sections which was won by the Floodplain Management Section, (3) a review
<br />of water issues considered in the past legislative session. (4) a brief overview of
<br />Congressional testimony and meetings in Washington, D.C., (5) a review of
<br />arrangements for the Cortez meeting and a tour of the Anasazi Heritage Center, (6)
<br />the status of the transfer of the Towaoc Pipeline to the Ute Mountain Ute Indian
<br />tribe, and (8) the low level response by CWCB members to participate on a float trip
<br />with the Wildlife Commi~~ion. Division of Parks and the State Land Board.

<br />Hal Simpson, Acting State Engineer, handed out a map of stateline flows and reported
<br />on the recent Costilla Creek Compact meeting, progress at Sanchez Reservoir, the
<br />generally low snowpack conditions statewide, issues related to Kansas v Colorado, and -IJ..
<br />HB 1131 concerning dam safety emergencies. .

<br />25. PreliminaIy Notice of Modification oClSF Right; Water Division 5, Snowmass Creek*
<br />(2:19 - 4:52 p.m.)

<br />Dan Merriman, CWCB staff, presented the preliminllTy notice to modify an existing
<br />instream flow water right on Snowmass Creek. Jay Skinner, DOW, presented the
<br />biological analysis and new flow recommendations based on new data. Questions were
<br />asked by Harrison and Lochhead. Christie Kline, AG staff, commented on the legal
<br />aspects of the recommendation. Vice-Chairman Martineau then opened the meeting
<br />for public comment.

<br />Jim Chadwick, aquatic ecologist for the Aspen Skiing Company; Fred Smith, Vice-
<br />President of the Aspen Skiing Company; and Harris Sherman, attorney for the Aspen
<br />Skiing Company spoke in favor of the change. ,Jim True, Chairman of the Pitkin
<br />County Board of Commi~sioners, and John Musick, attorney for Pitkin County raised
<br />concerns about the change. Jim Hooker, Snowmass Village Town Council; Terry
<br />Hunt, General Manager of Snowmass Resort Association; and Dick Wall, Chairman
<br />and President of the Snowmass Water Board and Mayor of Snowmass Village made
<br />additional statements. The speakers and staff were asked questions by Harrison,
<br />Lochhead, Evans, and Sheftel. Sherman and Musick responded to each other, and A
<br />Eisel recused himself from the vote. Sue Helm, resident of Snowmass Creek, and ,.
