1.87CW303: Beaver Brook
The applicant is proposing to exchange senior water rights decreed on
Clear Creek upstream to storage in two existing reservoirs on Beaver
Brook and to the North Beaver Brook Pipeline. Applicant has claimed
an appropriation date which is senior to the Board's appropriation on
Beaver Brook. The proposed stipulation provides that the CWCB will
amend its pending instream flow application to provide for
segmentation of the original instream flow reach and revised summer.

shall bypass, at the North Beaver Brook Pipeline, as much water as is
required up to the natural flow, to satisfy the applicable instream flow
on the upper segment. This requirement applies to the applicant's right
to divert water under the proposed exchange and to the applicant's
right to divert water under any of the applicant's water rights which
divert from North Beaver Brook. The applicant has also agreed to
withdraw its statement of opposition in the Board's pending
application.

5.90CW195: Horn Ranches. Inc.
The applicant is proposing to divert two senior irrigation rights at an
alternate point of diversion which is located approximately 1.5 miles
upstream on the Fraser River. The Board postponed ratification of the
statement of opposition filed in this case to allow the staff additional
time to evaluate the potential injury to instream flows. Staff has
determined that the original application was filed prior to the Board's
appropriation on the Fraser and was amended subsequent to the
Board's appropriation. The proposed stipulation recognizes the change
of water right claimed in the original application as senior to the
Board's appropriation and requires that diversions claimed in the
amendment be subject to the Board's instream flow appropriation on
the Fraser River. The staff is recommending that the Board ratify the
statement of opposition filed in this case and approve the proposed
stipulation with Horn Ranches.
