<br />/ <br /> <br />-,,1)/ <br /> <br />" ~/ <br /> <br />e <br /> <br />. <br /> <br />e <br /> <br />instream flow rights awarded to the United States of America pursuant <br />to the Wild and Scenic Rivers Act. <br /> <br />c. <br /> <br />1.87CW303: Beaver Brook <br />The applicant is proposing to exchange senior water rights decreed on <br />Clear Creek upstream to storage in two existing reservoirs on Beaver <br />Brook and to the North Beaver Brook Pipeline. Applicant has claimed <br />an appropriation date which is senior to the Board's appropriation on <br />Beaver Brook. The proposed stipulation provides that the CWCB will <br />amend its pending instream flow application to provide for <br />segmentation of the original instream flow reach and revised summer. <br />winter flows on both segments. It further provides that the applicants <br />shall bypass, at the North Beaver Brook Pipeline, as much water as is <br />required up to the natural flow, to satisfy the applicable instream flow <br />on the upper segment. This requirement applies to the applicant's right <br />to divert water under the proposed exchange and to the applicant's <br />right to divert water under any of the applicant's water rights which <br />divert from North Beaver Brook. The applicant has also agreed to <br />withdraw its statement of opposition in the Board's pending <br />application. <br /> <br />d. <br /> <br />4-90CW117: Wilson Mesa (deleted) <br /> <br />e. <br /> <br />5.90CW195: Horn Ranches. Inc. <br />The applicant is proposing to divert two senior irrigation rights at an <br />alternate point of diversion which is located approximately 1.5 miles <br />upstream on the Fraser River. The Board postponed ratification of the <br />statement of opposition filed in this case to allow the staff additional <br />time to evaluate the potential injury to instream flows. Staff has <br />determined that the original application was filed prior to the Board's <br />appropriation on the Fraser and was amended subsequent to the <br />Board's appropriation. The proposed stipulation recognizes the change <br />of water right claimed in the original application as senior to the <br />Board's appropriation and requires that diversions claimed in the <br />amendment be subject to the Board's instream flow appropriation on <br />the Fraser River. The staff is recommending that the Board ratify the <br />statement of opposition filed in this case and approve the proposed <br />stipulation with Horn Ranches. <br /> <br />f. <br /> <br />5-91CW173: Lane <br />Applicants have filed an application for junior water rights and a plantfor augmentation to fill a small off.stream pond along the Roaring <br />Fork River.
