instream flow right on the Roaring Fork River. The proposed
stipulation requires the applicant to curtail diversions under senior
water rights which they also own to offset the full amount of the junior
diversions into the pond. Applicants are also required to limit
diversions under the junior right to times when the senior rights would
be physically and legally available,

Applicants have filed an application for a plan for augmentation and
exchange to replace out.of.priority depletions by junior wells tributary
to the Blue River near Breckenridge. Applicants have acquired
storage water under the CWCB/Vidler Tunnel Water Company
Memorandum of Agreement to replace their winter depletions, and
have claimed a junior exchange of Vidler Tunnel direct flow rights to
replace summertime depletions. The proposed stipulation requires the
applicant to include the terms and conditions of the CWCB/Vidler
Agreement in their decree and identifies the junior date for
administration of the exchange.

30. Second Addendum to Donation Agreement with City of Boulder
The City of Boulder is proposing a Second Addendum to an existing
Donation Agreement to assign water rights to the Board for
maintenance of instream flows on North and Main Boulder Creeks.
The staff is recommending approval of the Second Addendum.

Status of Little Dry Creek Instream Flow Investigations
The Cities of Greenwood Village and Cherry Hills Village have
requested that the Board consider an instream flow appropriation on
tittle Dry Creek. The Board has made a formal request to the
Division of Wildlife to conduct the necessary biological studies and
prepare a recommendation on the amount of water required to
preserve the natural environment. The City of Greenwood Village has
hired a wetlands expert to assist the Division in the data collection
effort. It is expected that the field work will be completed this
summer and a formal recommendation will be presented to the Board
for consideration in the fall of 1992.
