Furthermore, the use of water pursuant to this plan must <br />comply with the terms of the CWCB/ Vidler Tunnel Water Company <br />Memorandum dated October, 1988. <br /> <br />e. <br /> <br />5.92CW030: Gessner and Robson <br />This is an application for water rights and a plan for augmentation on <br />the Blue River just upstream from Dillon Reservoir in Summit County. <br />The applicant's diversion may be senior to the Board's instream flow <br />water right on the Blue River. However, the proposed plan for <br />augmentation may allow the applicant to expand historic diversions. <br />Furthermore, the use of water pursuant to this plan for augmentation <br />must comply with the terms and conditions of the 1988 CWCB/Summit <br />County Upper Blue River Basin Memorandum of Agreement. <br /> <br />f. <br /> <br />5.92CW031: Perkins <br />This is an application for a plan for augmentation and exchange to <br />replace out.of.priority depletions by a junior domestic well tributary to <br />the Blue River near Breckenridge in Summit County. Applicant has <br />requested an allocation of water from the Summit County Small Users <br />Pool to implement the plan for augmentation. The proposed upstream <br />exchange of water decreed to the Carwood Ditch may deplete the <br />Board's instream flow rights on the Blue River if the exchange is not <br />administered with a junior date. Furthermore, the use of water <br />pursuant to this plan must comply with the terms of the <br />CWCB/Summit County Upper Blue River Basin Memorandum of <br />Agreement dated October, 1988. <br /> <br />Stipulations <br />With the exception of item 27b.,the staff has filed statements of <br />opposition to the following applications and is recommending that the <br />Board ratify the proposed stipulation in each of these cases to protect <br />the Board's instream Flow water rights. <br /> <br />a. <br /> <br />1.87CW315: AllensDark (deleted) <br /> <br />b. <br /> <br />1.87CW270: Cache In Poudre River <br />This is an application for instream flow water rights which was filed by <br />the Board and was opposed by the City of Thornton. The proposed <br />stipulation recognizes that the Board's decree shall not be construed <br />to require releases of water from Long Draw Reservoir or to prevent <br />the operation of historic exchanges. The stipulation further provides <br />that the Board's decree shall not be "stacked" together with any <br /> <br />9 <br />
