<br />1.13 Buffalo Park has entered into a contract to purchase
<br />shares of MMRC capital stock so that sufficient augmentation and
<br />replacement water will be available to cover projected depletions
<br />associated with water usage within. the Cragmont, Mountain Park
<br />Homes, Buffalo Meadows and Homestead Subdivisions. As a term and
<br />condition of this decree, Buffalo Park shall close on the purchase
<br />of sufficient shares of MMRC stock !to receive delivery of 7.874
<br />. acre .feet of firm yield consumptive ,use water per year as defined
<br />herein from the following water rights and storage facilities
<br />which MMRC holds for the benefit of its shareholders:

<br />a. Harriman Ditch. 7.71 shares of the 400 shares of
<br />capital stock (1.93%), issued and outstanding in the
<br />Harriman Ditch Company. Said company owns direct flow water
<br />rights decreed to the Harriman Pitch. Pursuant to the Decree
<br />entered in Civil Action No. 6832, on February 4, 1884, the
<br />Ditch was awarded the following, direct flow priorities:

<br />The Bear Creek headgate of th~ Harriman Ditch is located on
<br />the South bank of Bear Creek in the NE 1/4 NE 1/4, section 2,
<br />Township 5 South, Range 70 West, 6th P.M., Jefferson County,
<br />Colorado. The Turkey Creek headgate of the Harriman Ditch is
<br />located on the South bank of Turkey Creek near the Southwest
<br />. corner of Section 6, Township 5 South, Range 69 West, 6th
<br />P.M., Jefferson County, Colorado. The Ditch was originally
<br />decreed for irrigation, livestock watering, domestic and
<br />municipal purposes.

<br />The 7.71 shares described herein include 3.00 shares utilized
<br />on the Robertson Farm, locatecl in the NE 1/4 of Section 11,
<br />and the NW 1/4 of Section 12, Township 5 South, Range 69
<br />West, 6th P.M.; 1.63 shares utilized on the Nielsen property,
<br />located in the SW 1/4 of Section 11, Township 5 South, Range
<br />69 West, 6th P. M.; and 3.08 shares used on the Belquince
<br />property, located in the SW i1/4 of Section 11, Township 5
<br />South, Range 69 West, 6th P.~., all as depicted on the map
<br />attached as Exhibit "B."
