<br />. <br /> <br />- <br /> <br />-- <br /> <br />1/4 of Section 4 between U.S. Highway 285 and South Turkey <br />Creek Road, and the NW 1/4 NW 1/4 of Section 4 and the NE 1/4 <br />NE 1/4 of Section 5, all West of U.S. Highway 285, all in <br />Township 6 South, Range 70 West, 6th P.M., Jefferson County, <br />Colorado. See, attached Exhibits "A-7" and "A-S." <br />Applicant, Buffalo Park Development Company, proposes to <br />modify the Homestead Subdivision by reconfiguring some of the <br />larger lots into a minimum of two-acre residential and <br />commercial lots and "adding peripheral land to the existing <br />Subdivision. The existing water supply will be expanded <br />under this separate plan for augmentation to provide for a <br />maximum of 60 equivalent residential units under this decree. <br /> <br />SUMMARY OF RELIEF REQUESTED: <br /> <br />1.10 Regarding Bear Creek and its tributaries, not including <br />Turkey Creek, Buffalo Park seeks adjudication of a conditional <br />surface water right from Cub Creek, adjudication of conditional <br />underground water rights from tributary sources in the Bear Creek <br />drainage basin, adjudication of appropriative rights of <br />substitution and exchange to replace depletions associated with <br />water usage within the Cragmont and Mountain Park Homes <br />Subdivisions, and adjudication of an appropriative right of <br />substitution and exchange involving Sprucedale Reservoir and <br />Sprucedale Ditch, and a water storage right for Sprucedale <br />Reservoir. In addition, Buffalo Park seeks approval of a plan for <br />augmentation to replace depletions ass.ociated with water us"ge <br />within the Cragmont and Mountain Park Homes Subdivisions. <br />Regarding Turkey Creek and its tributaries, Buffalo Park seeks <br />adj udication of conditional underground water rights from <br />tributary sources in the Turkey Creek drainage basin, adjudication <br />of appropriative rights of substitution and exchange to replace <br />depletions associated with water usage within the Buffalo Meadows <br />and Homestead Subdivisions and approval of a plan for augmentation <br />to replace depletions associated with water usage within the <br />Buffalo Meadows and Homestead Subdivisions. <br /> <br />1.11 MMRC seeks a decree confirming certain changes in water <br />rights decreed to the Warrior Ditch, the Harriman Ditch and Soda <br />Lakes Reservoir Nos. 1 and 2; including the quantification of <br />historic consumptive use, and the firm yield of consumptive use <br />water available for augmentation, replacement and exchange <br />purposes from the portfolio of water rights and storage facilities <br />described herein.
