MR. KOCHMAN: Mr. Chairman, if~I could mention one other point~ c In
the-past the Division of .Wi1d1ifehas had a number of.meetings with
both the Bureau of Reclamation and Bureau of .Wi1d1ife Service con-
cerning this subject. It's a matter of record in one of the last
meetings - we had that the Bureau of Rec1aniation felt that those streams
-- that was worth discussing, but the complexity involved was - -
certainly not simple, but probably maybe a first step in accomplishing
that objective would be to make clear to the:Southeastern Water Con-.
servancy District that their senior rights would not be affected.

~
- ~ :
In a sense, if that happens today, then that step'is taken:;. and. I hope
then the next step is some more progressive meetings toward the
objective somewhere down the line of.maintaining-the flows.

MR. STAPLETON: Mr. Fetcher?

MR. FETCHER: I would like a.1itt1e clarification re1ated:to the
statement that Mr. Fischer made concerning irrigation return~f1ows.-
It's my understanding that where appropriations have been made that
depend o~-irrigation return flows that-they're. okay as long ~s the flow
is there, but if irrigation return flow -- if irrigation practices .
change and the return flows do not return, then you have no decree.
Is that- correct? -. .

- ..., - .....
MR. SPARKS:':That'~abso1~te1y.correct. There-is no way-..I-know of:that
ani' junior __appropriator can compel- sODieone:e1se to -keep 'on irrigating.
We-re :i.n no.different-shapethan.any other~junior appropriator. -We .:
can't c~:el people: to continue to irrigate lands if they don't want.:
to.
