I

decrees, and they ~o not affect in any way your right to your water,
except as Mr. Moses. says, there may be a problem if you change the.
use to which you've traditionally applied this water.

MR. QUINTANA: I understand.

MR. STAPLETON: I don't think we can explain it any more fully than that.
I think perhaps you ought to consult your own attorney in that regard.
This is our opinion which is given to you gratuitously, and lawyers
always say t~at you get what you pay for. .

You know we'd like to be helpful. We've given you our opinion, and I
don't think we can do any more, Mr. Quintana.

MR. QUINTANA: Okay. One more thing I'll stress is, according. to Leo
Gonzales, our water commissioner, the water in the Hot Creek is anywhere
from fiVe to seven feet any time during the year,. seven feet in the
spring, and down to five during the summer, so I don't -- I guess I
don't have anything else to say. Thank you.

MR. SPARKS: I might add, Mr. Quintana, we've shown Hot Creek by the
map on the wall. There are four diversions in this section of the
stream, as we've shown. All are senior, of course, and cannot be
diminished in anyway by any action we take.

But if there is some exchange practice that you're making up there that
you would like us to recognize, we will recognize whatever exchange
practice you're doing by decree, so you might consider that. If you
want any protective language, we're willing to put that in the:~ecree.

MR. QUINTANA: Well, I d,on't have any right now. Thank you.

MR. STAPLETON: Are there any further discussions? Yes, sir"Mr.
Kochman. .

MR. KOCHMAN: Eddie Kochman with the Division of Wildlife.

In listening to the wording prgposed by Mr. Beise, I can well under-
stand the intent of that wording, as well as the need for it. It's not
the intent of the Division of Wildlife to detrimentally influence any
senior decree on Lake Creek, or Halfmoon,.or the Lake Fork. It's only
our intent-to hopefully have a relationship that we can. work with the
Southeastern Water Conservancy District, with the Bureau of Reclamation,
and with this Board.in trying to maintain what we feel are reasonable
flows in each of those streams, and I hope as time goes on that we can
do this.

I

One other thing I want to mention in regard to some of.the La Jara
flows. We made recommendations on Jim Creek and Torsido Creek. This
year.we poisoned each of the creeks in an attempt to get rid of some
of the rough fish and try and reintroduce Rio Grande Cutthroat into
each one of the streams,

MR. STAPLETON: That's where all the endangered species are.going.

-9-
