MR., KOCHMAN: - That:' s where they I re going.. : But, unfortunately, we
didn't get the fish from Ricardo Creek. _ That operation:was successful,
and I think that the decrees. on both Jim Creek:and. Torsido Creek might
be of some value in the future in protecting those streams. We view
that operation as very successful, and probably as time goes on, each
of those streams will have a popu~ation ~f Rio Gr~nde Cut~hroat.

MR. O'NEIL: _ My name is Dennis. O'Neil, and r:. have"property up' in the._
Lake County area, and I'm. very..concerned about minimum streaniflows, :
and particular reference to the. Fryingpan-Arkansas Project.:

They've 1;>een like a~steamroller'up-in the county, gOing..over everybody
in many ways, taking some of our":best land, and I happen to now have B-
little land along Lake Creek and along the Arkansas River, and it's
~ried uPr particularly right now~ :to where. a hors~ can walk across the
-~ce. It s about two feet across. In the summert~ they let up to
700 cubic.feet.per- second-down: the:river, and it's-flooding:out..

I

We had an
same way,
River-.

instance last winter where it. flooded
hampering working ~ith cows ~nd stock
...... - -..

the Arkansas River the
across. the Arkansas

First-off~ I'm interested in~protecting the value of fuy:land by keeping
the 15 feet perssecond along Lake-Creek, and I think if the:Fryingpan";
Arkansas Project is let.run loose like they've been, they're drying up
the streams, then they might as:w~ll: finish buying up the:rest of the
land along these streams.beca~se we'll have nothing-left but-rock~piles,
whereas we have: for many:years.had.a nice recreational.area for-fishing
and hunting~ and:weJd: sort. of like to. continue building- in that area.

Second, we have a problem:up there right now.where jUnior water holders
like myself to work water from Lake Creek below the lakes and above
the lakes.,. During the wintertime they cut the floW off to close the.
gates down completely, so there's, obviously, leakage water coming
through this which hampers us ~n.many way~ that we, essentially, have
no stream in the:wintertime. So:1 think: this minimum flow should be.
adjusted as to what's coming into the lakes from drainage above, n9t
from the transmountain diversion project. .

So, fir~t, I'm interested in the minimum flows~ and I don't particularly
care-for the.language that Mr. Beise asked: for. the Fryingpan-Arkansas
Project unless this same language is going to apply.to people like my-
self, individuals who have water rights,~that.we would.have the same -
type of-language with reference. to our water rights.

Thank you.
MR. STAPLETON: : Thank you,

Is there further comment?

I

-.

.
MR. FISCHER:. Mr; Chairman, I do have further. comments of a general
nature. That is..that we would like to point out we're getting
increasing expressions of concern by irrigators. that a minimum flow,-
especially far down on the stream, which in some instances appropriates
return flow, might in fact ultimately: be interpreted as a:requirement

-10-
