We have eliminated at this meeting all consideratiort~~f: <br />streams in Eagle County. QUINTANA: Mr. Chairman, membe:r:s of the -Board, I'm Andrew Quintana. <br />I'm a Hot Creek .water user, and in view of the .comments - - I've been - <br />up here once. before -~ I've got some questions, a question here-that's <br />not quite answered on this -minimtun stream flow. <br />-. ~ - - <br /> <br />I <br /> <br />My abstract reads on that, "One-tenth undivided interest in and to-all <br />the water decreed to the Agua Ca1iente Ditch," which is the Hot Creek. <br />How wou1d.~-abstract, or what would my water rights read:if there is <br />another decree or appropriation filed on the Hot Creek now? <br /> <br />MR. The only. thing it does, and you <br />should be aware of tnis; is it 'may affect your ability to change the <br />point of-diversion or €ake~fhe water out of the Hot Creek drainage -into <br />some other drainage. ... ~ . <br /> <br />As long as you're continuing your present irrigation practice at your <br />present headgate, it will not affect you at all. <br /> <br />MR. MOSES: Let me explain that a little fUFther~ This will be:a 1977. <br />priority, and it's just like any other priority that's junior to yours. <br />It's recognized only when.a11~the senior-priorities have been recognized. <br /> <br />MR. QUINTANA:: Okay. Well, .this: stream, -it's like it says here,. :is <br />eleven miles long. I believe that the "water that Hot Creek water users <br />use is within an area of at most three and a half miles. Now, the rest <br />of that eleven miles is already in state 1and~ The State Game and Fish <br />own one-tenth of that, so I would recommend, you know, that it be left <br />that way. <br /> <br />I <br /> <br />We've got four and they've got the rest of the eleven, which is six <br />miles or more, which is again state land and state-owned, and they do <br />have an interest on it already, .so. I :don't see where there 's room for <br />any other apprbpriation' or any other .:decrees. It reads, "One-tenth <br />interest to all this water" already. <br /> <br />MR.
