The Board shall netermine that the natural environment <br /> <br />will be preserved to a reasonable degree by the water <br />available for the appropriation to be made; that there <br />is a natural environment that can be preserved to a <br /> <br /> <br />reasonable degree with the Board's water right, if <br /> <br /> <br />granted. and that such environment can exist without <br /> <br /> <br />material injury to water rights. <br /> <br />v. Filing of Water Rights Applications <br /> <br />A. Within five days of the Board's final approval, the <br /> <br /> <br />staff shall forward the approved appropriations to the <br /> <br /> <br />AG, which shall file applications in the appropriate <br /> <br /> <br />water court and represent the Board in all subsequent <br /> <br /> <br />court proceedings on the subject water right claims. <br /> <br />B. Such filings shall claim as the date of appropriation <br /> <br /> <br />the date the Board acted to approve the appropriations. <br /> <br /> <br />Such filings shall be subject to the provisions of <br /> <br /> <br />37-92-102(3)(a) and (b), CRS 1973, as amended. <br /> <br />C. The ewcs, DOW, ann DPOR will provide technical support <br />to the AG during the water court proceedings. <br />-3- <br />
