County Land Use Policies and HB1041 Reaulations <br />Staff has reviewed and provided some basic in.formation on county land use powers, A <br />5 page overview from the Dept. of Local Affairs, Office of Smart Growth, entitled "Land <br />Use Planning in Colorado" is attached, So-called "1041 regulations" are a special case <br />of land use powers relating to matters of statewide concern, and have been used <br />effectively by some counties to control water project development within the county, <br />The regulations give counties review and approval authorities over the siting, design, <br />and construction of water project facilities, They do not give a county the pOWElr to <br />regulate activities that occur in another county, nor to prohibit a change in the point of <br />diversion to a location in another county as often occurs in an agricultural to urban <br />transfer, 1041 regulations could be a powerful tool where an ag-urban transfer requires <br /> <br />1 <br /> <br />. <br />
