Surveys conducted in 1992 and updated in 1998 found that 9 of 64 counties <br />had 1041 regulations pertaining to domestic and/or industrial water projects and 15 of <br />63 had regulations re siting of public utility facilities. In addition 6 counties had 1041 <br />regulations dealing with efficient utilization of municipal and industrial water projects. <br />Counties utilizing 1041 powers with regards to water development can be broken down <br />as follows: Metro 2 [Arapahoe, Douglas], Mountain 10 [Eagle, Gilpin, Gunnison, <br />Jackson, LaPlata, Lake, Ouray, Pitkin, Summit, Teller], Rural/Agricultural 7 [Bent, <br />Costilla, Morgan, Rio Blanco, Saguache, San Miguel, Weld]. In addition some 19 rural <br />counties have land use policies regarding the retention of agricultural lands and water. <br />Those policies are believed to be more aspirational rather than enforceable, but staff <br />has not contacted individual counties to verify this assumption. <br /> <br />IV. "Concernina the Authoritv of the Governina <br />Bodies of Local Governments to Protect the Use of Aaricultural Water Riahts" <br />Staff has compiled copies of the bill, amendments and testimony in the Senate <br />Committee on Agriculture and Natural resources, A copy of the bill as amended <br />through Feb, 26 is attached. There are numerous parallels between the Hillman/Kester <br />bill and the issues being presented to the Board during its consideration of an <br />agricultural water policy. <br /> <br />2 <br />
