I think perhaps by way of back- <br />ground, it would be well to mention the fact <br />that the Costilla Creek Compact, as it now <br />exists, is perhaps one of the most detailed <br />compacts we have. By that I mean it goes into <br />detail on the points of diversions for the <br />various ditches diverting from that stream and <br />there are no provisions in the compact itself <br />for amendments to the compact. <br /> <br />Mr. Moses, who is the attorney for the <br />Board, represents the Colorado water users <br />in this matter and he has gone into the Dis- <br />trict Court of Colorado to try to seek a change <br />of point of diversion on behalf of those water <br />users. Of course what we have here simply is <br />this, we have an interstate stream winding in <br />and out of the two states and we have this <br />compact superimposed upon the jurisdiction of <br />the courts of both Colorado and New Mexico and <br />the river is handled entirely, as far as its <br />administration, through the Compact Commis- <br />sioners, 11r. i1.hitten of Colorado and Mr. <br />Reynolds of New Mexico. For several years the <br />Compact Commission has been concerned with this <br />problem. <br /> <br />1 <br /> <br />\tlhat these amendments primarily do is <br />change the point of diversion from present place <br />of diversion to another ditch.
