JOHNSON: "There are a great many issues involved in the <br />Upper States Compact. If he has the power to <br />restrict them to certain issues, that is one <br />thing; if they open up the whole compact, that <br />is another thing. If they open up any part of <br />the Compact which affects the Upper States, <br />and especially Colorado, do you think it would <br />be wise in keeping out of that case?" <br /> <br />MR. CHIlBON: '~en we first discussed this last fall, I <br />felt this wa~ about. it--that if the Master <br />decides that we are not to be parties to this <br />suit, he will limit the issues only to those <br />that are necessary to divide Lower Basin water, <br />and if he does that, then Colorado and the <br />other Upper Basin States will not have any <br />substantial rights affected by the litigation. <br />If, however, the Master should eliminate us as <br />parties and then later should determine to <br />litigate such things as inter-basin rights and <br />obligations, then it may well be that the <br />Upper Basin States may have to go to the Court <br />and say you are litigating questions that are', <br />vitally affecting us and we wish to be heard." <br /> <br />"You will have that privilege?" <br /> <br />GOV.
