<br /> <br />The Directo~ and Royce J. Tipton, Consulting Engineer of the Board, <br />made a report concerning the present statu.., of the work of the Committee of <br />Sixteen, Colorado River Basin, whi ch for the past several m ontha, had been <br />dealing with the question of a proposed allocation of Colorado river wate~ <br />between the United States and Mexico. The Committee of Sixteen had been <br />dealing and consulting with the Department of State on the United States~Mexico <br />,matter preliminary to proposed treaty negotiation.. between the two countries for <br />the adjustment of the problem. Particular" attention was called to the current <br />discussion of a proposal for arrangements to make temporary deliveries' of water <br />by the United States to Mexico. The report covered the meeting of the Committee <br />of Sixteen at Los Angeles, California, on November 16-18, 1942, and subsequent <br />conferences of a sub-committee dealing with the same subject. This report <br />followed by discussion of the subject was made in order to keep the Board fully <br />advised. <br /> <br />The Director then made a report concerning the status of the pending <br />negotiation!! among the representatives' of the States of Colorado, Kansas and <br />Nebraska for a compact providing for the allocation of the waters of the <br />Republican River. <br /> <br />The meeting recessed at 5:~0 P. M. to recOnvene at 9:30 A. M. <br />,Wednesday, December 23, 1942. <br /> <br />The meeting reconvened at 10:45 A. M., Wednesday, December 23, 1942, <br />with Vice-Chairman Chris Wallrich presiding. A quorum was declared present, <br /> <br />The Director' called attention to the presence at the Board meeting of <br />C. C. Hezmalhalch, Deputy State Engineer, who was acting in the absence of <br />M.,C. Hinderlider' who was then on a temporary leave of absence. <br /> <br />The Directorr then presented to the Board the question of the p~oposed <br />amendment to Section 13 (b) Chapter 266 Session Laws of Colorado, 1937. This, <br />question had been before the General Assembly in 1941 and it seemed necessary <br />that further efforts, should be made to obtain approval of an appropriate amend- <br />ment by the forthcoming General Assembly. He explained the efforts which had <br />been made by a special sub-committee, after consultation with Commissioner <br />John C.Page, S.-O. Harper, Chief Engineer and E. B. Debler, Chief Hydraulic <br />Engineer of the Bureau of Reclamation concerning this proposal. During the <br />discussion Governor Elect John C. Vivian entered the meeting and was asked to <br />express his view's on the subject. Others who appeared and participated in the <br />discussion were Chief Engineer S. O. Harper cf the Bureau of Reclamation. Judge <br />A. W. McHendrie representing the Arkansas Valley Ditch Association, and Jean S. <br />Breitenstein, Attorney for the Colorado Water Conservation Board. <br /> <br />After discussion of appropriate language for the proposed amendment, <br />the following language was drafted for further consideration: <br /> <br />"PROVIDED, HOWEVER, that any project development providing for <br />the exportation of water from the natural basin of any river subject <br />to the Colorado River Compact and the Boulder Canyon Project Act, as <br />amended, by any district created under this Act shall be subject to <br />the provisions of the Colorado River Compact and the Boulder Canyon <br />Project Act, including all amendments thereof, and shall be designed, <br />constructed and operated in such a manner that the present and pro- <br />spective developments to be determined and defined agreeably to the <br />interest affected by the proposed project development and to be in- <br />cluded in the project plans within the natural basin in the state of <br />"" <br />
