<br />FINAL DECISION <br /> <br />Because the proposed project meets all of the requirements of .9 36-20-112, CRS, it is <br />hereby determined that the permit is approved with the following conditions to be more fully <br />described in the terms and conditions of the permit: <br /> <br />1. The permit shall be limited to the purpose of augmenting snow for enhanced <br />operation of the ski area and for enhancement of runoff for irrigation purposes. <br /> <br />2. Said permit shall be for the period from November 1,1997, through March 31,1998, <br />with conditional approval given for future years' operations for the five month period <br />from November 1 through March 31 beginning in the years 1998, 1999,2000, and <br />2001, subject to the permit renewal requirements of section 36-20-114(2), CRS, and <br />subject to the Colorado Weather Modification Rules and Regulations. <br /> <br />3. The person in control of the project must maintain a high level of coordination by <br />consulting with and informing the federal agencies, state agencies, local <br />governments, and private entities listed under the terms and conditions of the permit. <br /> <br />4. The maximum rate of release of silver iodide from any single generator will be <br />limited to the rate reasonably necessary to achieve the intended results in the target <br />area. <br /> <br />5. The actual snowpack as measured by selected automated "snotel" sites and snow- <br />courses will be compared with the 30-year long term average suspension criteria on <br />a weekly basis (which is more frequent than the more traditional monthly basis). <br /> <br />6. The applicant must pay the annual commercial fee estimated in the first year at 2% <br />of$54,000 = $1,080. <br /> <br />7. The applicant must prepare written monthly progress reports and a final report at the <br />end of the project in accordance with the requirements of the permit. <br /> <br />8. The weather modification permit shall be further subject to such other terms and <br />conditions as are set forth in the permit. <br /> <br />9.
