16. The proposed project is a commercial project and not a research and development
project. The snowfall sampling program proposed by some objectors intended to
refme the estimates of the magnitude and extent ofthe seeding operation, is beyond
the scope of this commercial weather modification project.

17. Opposition to the application on the basis that the opponent is morally, ethically or
otherwise opposed to technology in general or weather modification specifically is
not sufficient grounds for denying the application.

18. Opposition to the application from a fear that a strong El Nino will cause excessive
precipitation to fall iri the region is not sufficient grounds for denying the application.
The natural variability in snowpack, weather from El Nino or other natural causes,
is taken into account by the application of suspension criteria to the long-term
average snowpack measured in the target area.

19. It does not appear that the seeding agent from the proposed weather modification
project will contribute to any air pollution problem related to EP A's designated
nonattainrnent area for Telluride based on air quality standards for particulate matter.

20. Based on the information in the proposed operational plan, testimony provided at the
public hearing, and the information and materials reviewed in the administrative
record, the proj ect:

A. is reasonably expected to benefit the people in the area in which the operation
will be conducted by augmenting snow for enhanced operation of the ski area
and providing additional snowmelt runoff for irrigation purposes [ ~ 36-20-
112 (3)(b), CRS],

B. is scientifically and technically feasible [ ~ 36-20-112 (3)(c), CRS],

C. does not involve a high degree of risk of substantial harm to land, people,
health, safety, property, water rights, or the environment [ 9 36-20-112 (3)( e),
CRS],

D. includes adequate safeguards to prevent substantial damages to land,
property, water rights, people, health, safety, or the enyironment [ 9 36-20-
112 (3)(t), CRS],

E. will not adversely affect another weather modification project [ 9 36-20-112
(3)(g), CRS], and

F. is designed to minimize risk and maximize economic benefits to the residents
of the area [ 936-20-112 (3)(h), CRS].

7
