<br />DECISION AND PERMIT-Page Two <br /> <br />WY82-1 <br /> <br />d. Advice, comments, and recommendations of the Weather <br />Modification Advisory Committee tendered to the <br />Executive Director on October 21, 1981 as well as <br />comments subsequent to that date. <br /> <br />e. Weather Modification Act of 1972, Article 20, <br />Title 36. CRS 1973. <br /> <br />f. Weather Modification Rules and Regulations effective <br />September 12, 1973. <br /> <br />2. The proposed program is under the sponsorship of parties listed <br />in Attachment A attached hereto. <br /> <br />3. The sponsorship of the proposed program is designed to undertake <br />a commercial weather modification program within the project area to <br />provide additional snowfall for recreational purposes and additional <br />snowmelt runoff for water supply. <br /> <br />4. The Applicant has demonstrated that the persons in control of <br />the project received valid weather modification licenses"and those <br />persons are Lawrence M. Hjermstad and Richard A. Medenwaldt. <br /> <br />5. The applicable permit fee is $100.00 plus 2% of the total final <br />contract. <br /> <br />6. Proof of. financial responsibility, by means of a prepaid <br />insurance policy for $1,000,000 is required for this permitTto <br />become effective. <br /> <br />7. The Applicant has submitted an operational plan for the proposed <br />project which plan meets the requirements of CRS 1973, <br />36-20-1l2(1)(d) and which is incorporated into these findings by <br />reference. <br /> <br />8. The project appears to be conceived and offers promise of <br />providing economic benefit to the area in which the operation will <br />be conducted. Data supporting economic benefit was presented by the <br />project sponsors in the permit application and at the public hearing <br />October 21, 1981. The recommendation of the Weather Modification <br />Advisory Committee supports this finding. <br /> <br />9. The project appears to be reasonably expected to benefit people <br />in the area and benefit the people of the State of Colorado. The <br />recommendation of the Weather Modification Advisory Committee <br />supports this finding. <br /> <br />10. The project is scientifically and technically feasible. The <br />recommendation of the Weather Modification Advisory Committee <br />generally supports this finding. <br /> <br />11. The project does not appear to involve a high degree of risk of <br />substantial harm to land, people, health, safety, property, or the <br />environment. The recommendation of the Weather Modification <br />Advisory Committee supports this finding. <br /> <br />12. The project, subject to the terms and condition of the pebmit, <br />is designed to include adequate safeguards to prevent substantial <br />harm to land, people, health, safety, property, or the environment. <br />The recommendation of the Weather Modification Advisory Committee <br />supports this finding. . <br /> <br />P age Two <br />
