The target area in Colorado includes all of Ranges 42 West and 43 West between <br />Townships 1 North and 5 South inclusive in Yuma County, Ranges 41 West and 42 <br />West between Townships 5 Y, South and 11 South inclusive in Kit Carson County, <br />and Ranges 41 West and 42 West between Townships 12 South and 16 South in <br />Cheyenne County. <br /> <br />13. The area in Colorado reasonably expected to be affected by the project includes the <br />target area described above and all of the remaining area in Yuma, Kit Carson, and <br />Cheyenne counties. <br /> <br />14. Colorado's Weather Modification Act of 1972 ("the Act"), at S 36-20-112(1)(d), <br />CRS, does not specifically address special requirements for interstate weather <br />modification permits. However, the State of Kansas is in support ofthe project, has <br />issued a permit for the proj ect, and does not prohibit weather modifications <br />operations to be carried on in Kansas for the benefit of Colorado or its inhabitants. <br />[ S 36-20-118, CRS] <br /> <br />15. The decision to issue a Colorado weather modification permit is based on the criteria <br />in S 36-20-101 et. seq" CRS as it applies to that part of the operational area located <br />in Colorado. <br /> <br />16. <br /> <br />Based on the information in the proposed operational plan, testimony provided at the <br />public hearing, and the information and materials reviewed in the administrative <br />record, and considering the proposed operational area in Colorado, the proj ect: <br /> <br />, <br /> <br />A. is reasonably expected to benefit the people in the area in which the <br />operation will be conducted or benefit the people of the state of <br />Colorado [ S 36-20-112 (3)(b), CRS]. The term "operation" means <br />the performance in Colorado of any activity to attempt to modify or <br />having the effect of modifying natural weather conditions ... [ S 36- <br />20-104(4), CRS]. <br /> <br />B. is scientifically and technically feasible [ S 36-20-112 (3)(c), CRS], <br /> <br />C. does not involve a high degree of risk of substantial harm to land, <br />people, health, safety, property, water rights, or the environment [ S <br />36-20-112 (3)(e), CRS], <br /> <br />D. includes adequate safeguards to prevent substantial damages to land, <br />property, water rights, people, health, safety, or the environment [ S <br />36-20-112 (3)(f), CRS], <br /> <br />E. will not adversely affect another weather modification project [ S 36- <br /> <br />6 <br />
