<br />dated August 28, 1992, which evidences that the applicant is covered by <br />comprehensive general liability insurance in the amount of $2 million each <br />occurrence through Old Republic Insurance Company licensed to do business <br />in Colorado. <br /> <br />6. Legal notice of intent was published on October 2 and 9, 1992, in the <br />appropriate public newspapers in Grand County and in the adjacent eight <br />counties. <br /> <br />7. A public hearing on the application was held on October 15, 1992 at Hot <br />Sulphur Springs, Grand County, Colorado, this being not more than one week <br />following completion of the publication of legal notice. <br /> <br />8. The target area is the Willow Creek drainage basin upstream of Willow Creek <br />Reservoir, Grand County, Colorado. The area reasonably expected to be <br />affected are those areas above 9,000 feet M.S.L. and inside and immediately <br />adjacent to the target area and the uppermost ridges immediately downwind <br />of the target area. <br /> <br />9. The project is intended to augment natural precipitation within the target area <br />to provide improved snowpacks and additional water supplies for storage and <br />beneficial use. <br /> <br />10. The project will utilize not more than fifteen (15) ground based generators. <br />Seeding will be done with silver iodide. <br /> <br />11. The operational plan for the project as set forth in Exhibit A of the permit <br />issued even date herewith meets the requirements of section 36-20-112(1)(d), <br />C.R.S. <br /> <br />12. The project is conceived to provide and offers promise of providing economic <br />benefit to the area in which the operation will be conducted by increasing <br />snowpack. <br /> <br />13. The project can be reasonably expected to benefit people in the area and <br />benefit the people of the State of Colorado. <br /> <br />14. The project, under the terms and conditions of the permit: <br /> <br />A. Is scientifically and technically feasible, <br /> <br />B. Does not involve a high degree of risk of substantial harm to land, <br />people, health, safety, property, water rights, or the environment, <br /> <br />C. Includes adequate safeguards to prevent substantial harm to land, <br />property, water rights, people, health, safety, or the environment, <br /> <br />3 <br />
