The proposed project is a commercial project and not a research and development <br />project. <br /> <br />17, Based on the information in the proposed operational plan, testimony provided at the <br />public hearing, and the information and materials reviewed in the administrative <br />record, the proposed weather modification operation: <br /> <br />A. is reasonably expected to benefit the people in the area in which the operation <br />will-be conducted [936-20-112 (3)(b), CRSJ, <br /> <br />B. is scientifically and technically feasible [936-20-112 (3)(c), CRSJ, <br /> <br />C. does not involve a high degree of risk of substantial harm to land, people, <br />health, safety, property, water rights, or the environment [936-20-112 (3)(e), <br />CRSj, <br /> <br />D. includes adequate safeguards to prevent substantial damages to land, property, <br />water rights, people, health, safety, or the environment [936-20-112 (3)(f), <br />CRSj, <br /> <br />E. will not adversely affect another weather modification project [936-20-112 <br />(3)(g), CRSj, and <br /> <br />F. is designed to minimize risk and maximize economic benefits to the residents <br />of the area [936-20-112 (3)(h), CRS]. <br /> <br />FINAL DECISION <br /> <br />Because the proposed project meets all of the requirements of 936-20-112, CRS, it is hereby <br />determined that the permit is approved with the following conditions to be more fully described in <br />the terms and conditions of the permit: <br /> <br />1. The permit shall be limited to the purpose of augmenting snow for enhanced <br />operation of the ski areas and for enhancement of runoff for irrigation purposes. <br /> <br />2. Said permit shall be for the period from November 1, 2000, through March 31, 2001, <br />with conditional approval given for future years' operations for the five month period <br />from November 1 through March 31 beginning in the year 2001 and extending <br />through the year 2010, subject to the permit renewal requirements of 936-20-114(2), <br />CRS, and subject to the Colorado Weather Modification Rules and Regulations, <br /> <br />7 <br />
