<br />10. <br /> <br />11. <br /> <br />12. <br /> <br />15, <br /> <br />5, <br /> <br />Proof of financial responsibility has been provided by the applicant by means of <br />Certificate of Insurance dated November 3, 1999, which evidences that the applicant <br />is covered by commercial general liability insurance in Ihe aggregate amount of $1 <br />million through Essex Insurance Company (ADCO General Corporation), which is <br />licensed to do business in Colorado, [S36-20-112(1)(c), CRS] <br /> <br />6. <br /> <br />The proposed Operational Plan for the project submitted by the applicant meets the <br />requirements of S36-20-112(l)(d), CRS. <br /> <br />7, <br /> <br />The areas outside of the target area reasonably expected to be affected by the project <br />are those areas above approximate elevation 9,500 feet inside and immediately <br />adjacent to the target areas in the upper Eagle Riyer graiI]age basin and the uppermost <br />ridges immediately downwind of the target areas, as shown on the project area map. <br /> <br />8. <br /> <br />The area that may reasonably expected to be affected by the proposed project does <br />not overlap any other areas reasonably expected to be affected by other winter <br />weather modification projects in Colorado, <br /> <br />9. <br /> <br />Legal notice of intent to modify weather was published in a timely manner in the <br />official newspaper of Eagle County, and in the official newspapers of the adjacent <br />counties of Summit, Lake, Pitkin, Garfield, Routt, and Grand. [S36-20-112(1)(e), <br />CRS] <br /> <br />A public hearing on the application was held beginning at 1:15 p.m. on Thursday, <br />August 24, 2000, and ending at 3:00 p.m. in the Community Room of the Vail <br />Public Library, 292 West Meadow Drive, Lionshead, Vail, Colorado. The hearing <br />was conducted in the immediate vicinity of the target area and not more than one <br />week following the completion of publication. The hearing was attended by 5 <br />persolIS in addition to the hearing officer. [S36-20-112(2), CRS] <br /> <br />The project has the potential to generate up to 7,500 acre-feet of additional snowmelt <br />runoff per season. <br /> <br />The applicant has shown that significant economic benefits can be obtained by <br />improving the depth of the snow base on opening day. <br /> <br />13, <br /> <br />The target areas and the area that may be affected are located on portions of the White <br />River National Forest. A portion of the area south of the Beaver Creek ski area that <br />may be affected is part of the Holy Cross Wilderness Area, but the impact of the <br />project in this area is not expected to be significant. <br /> <br />14, <br /> <br />The proposed project is a "ground-based winter cloud seeding" project as defined by <br />statute and is intended to be operated between the months of November through May <br />of each year, [S36-20-104(2.5), CRS] <br /> <br />The project is expected to use between 30 and 45 pounds of silver iodide per year as <br /> <br />6 <br />
