<br />D. By written consent of all persons protected under Paragraph B, the provISIOns of <br />Paragraph C may be substituted, <br /> <br />E, A sound test by a qualified expert shall be conducted outside at each residence within <br />2.0 miles of each hail cannon. The sound level at any residence shall not exceed 80 <br />decibels or the appropriate Colorado Department of Health standard (such as the <br />threshold of hearing loss due to long term exposure), whichever is more stringent. <br /> <br />F. If decibel readings at any residence exceed ,the above limit, the sound protection <br />measures shall be improved until the sound levels are within acceptable limits, <br /> <br />5. Management of the hail cannon project will be under the direct personal control of Mr. <br />Mark'Inness of Center; Colorado, 'who is empluyed -as the Farm Manager for Colorado <br />Southern Farms, LLC. This includes day-to-day operations of when, where, and how long <br />to activate the various components of the hail cannon network. The Permittee shall <br />annually furnish the Director with an up to date contact list for haiJ cannon operations. <br /> <br />6, The project will be conducted only under conditions when use of a hail cannon is likely to <br />be beneficial in the target areas. <br /> <br />7, The Permittee shail refrain from indiscriminate operations, which may be grounds for <br />revocation of this permit, However, limited testing for sound control, demonstrations, <br />calibration, and start up will be permitted, <br /> <br />8, The Permittee shall not undertake, or shall suspend operations if at any time: <br /> <br />A. low flying aircraft are above the cannon, or <br />B. birds are visible flying above the cannon, or <br />C. the Director orders suspension for any reason, <br /> <br />9. The Permittee shall carefully control operations to avoid substantial harm or <br />damage to people, land, property, health, safety, or the environment. The <br />Permittee shall monitor sound levels, keep a record of precipitation as rain or <br />hail, respond quickly to citizen complaints, and requests for information from the <br />State, <br /> <br />10, The Permittee shall prepare and maintain the following written records and <br />reports: <br /> <br />A, A daily record of operations that includes at a rninimum the information required by <br />Form WM3 (copy attached), docwnentation of meteorological conditions during <br />operations for later evaluation by others, information on which operating decisions are <br />based, and information utilized in making suspension decisions, shall be maintained by <br />the permittee at its offices, <br /> <br />3 <br />
