<br />TERMS AND CONDITIONS

<br />This permit is limited by and subject to the following terms and conditions:
<br />
<br />-
<br />I. The project must be carried out in conformity with the Operational Plan attached hereto as
<br />Exhibit A, except for those operations modified by these terms and conditions.
<br />
<br />2. Not more than eight (8) ground based hail cannons shall be operated. The hail cannons
<br />shall be installed at or near the following fixed locations, Any subsequent change in the
<br />number or location of generators or of operators shall require the prior written approval of
<br />the Director.
<br />
<br />I. The center of Section 3, T41N, R9E, NMPM
<br />2, The SE comer of the SW '14 of Section 10, T41N, R9E, NMPM
<br />3. The center ofSection-IO;T41N,-R9E;NMPM-
<br />4. The NE comer of Section 16, T41N, R9E, NMPM
<br />5, The center of Section 17, T41N, R9E, NMPM

<br />3. The target areas shall include portions of Township 41 North, Ranges 7 and 9 East, New
<br />Mexico Principal Meridian CNMpM) as listed below, ali located in the South central part of
<br />Saguache County, Colorado (see map in Exhibit A),
<br />
<br />Sections 3 and 10, T41N, R9E, NMPM
<br />The NW '14 of Section 15, T4IN, R9E, NMPM
<br />All but the SE '14 of Section 16, T41N, R9E, NMPM
<br />Sections 17 and 20, T41N, R9E, NMPM
<br />
<br />The SE '14 of Section 25, T4l N, R7E, NMPM
<br />The NE '14 of Section 36, T4IN, R7E, NMPM
<br />
<br />4. The Permittee shall install the following sound protection measures intended to mitigate
<br />the effects of potentially excessive sound at residential locations:
<br />
<br />A. If a residence is within 0.5 mile of the location of a hail cannon, the cannon shall be
<br />placed in a recessed, concrete lined conical depression, at least 5 feet deep and
<br />surrounded by a sound barrier at least 16 feet high, The sound barrier may be
<br />constructed of straw or hay bales at least 4 feet wide,
<br />
<br />B, If a residence is 0,5 mile or more from the location of a hail cannon and less than 2,0
<br />miles from the cannon, a sound barrier at least 12 feet high shall be placed around the
<br />cannon, The sound barrier may be constructed of straw or hay bales at least 4 feet wide,
<br />
<br />C, If a residence is more than 2.0 miles from the location of a cannon, no sound protection
<br />is required.
