AGUA and Southwest have agreed that AGUA will operate the substitute water
supply plan with water owned by Southwest. A copy of the agreement will be forwarded to the
Division Engineer's Office prior to March 31, 1997. Southwest has turned over 180 shares of the
Excelsior Ditch (included in the 1,187 shares described in Section 6.1) which AGUA may use for
replacing evaporative and other replacement requirements for the gravel pit. Southwest's shares will
provide an average of 123 acre-feet of replacement credits (based on the 1908-1985 historical
Excelsior Ditch diversions), sufficient for their anticipated replacement requirements of 100.2 acre-
feet. AGUA may use the 23 acre-feet of excess Excelsior credits for replacement requirements of
its membership and in return will provide replacement water to augment Southwest's depletions
when the Excelsior shares are not generating sufficient replacement credits. AGUA's replacement
credits attributable to Southwest Ready Mix shares are included in the analysis previously presented
in Section 6.1.

8.3 Anaya Well SWSP and Todd Well SWSP

Two individually owned wells which were included in AGUA's Arkansas River
Replacement Plan in 1996 must now have their own substitute water supply plans (letter from Hal
Simpson to Dan Ault, dated July 31, 1996). The Anaya well (lD 1005129) and the Todd well (lD
1005130) expect to use 1.215 acre-feet and 1.400 acre-feet respectively for commercial purposes
related to horse boarding and including household use and lawn watering. Total wellhead depletions
are determined to be 0.648 acre-feet and 0.725 acre-feet respectively. Replacement requirements
during the 1997 plan year are 0.608 acre-feet and 0.680 acre-feet respectively. The SWSP proposes
a schedule of replacement requirements per month. AGUA has agreed to provide the replacement
water for the operation of the Anaya and Todd substitute water supply plans.

G:\3177 ~ OOJ\REPORTS\AGUA97 _1 RPT

30

PrintedFebruary27,1~7
