On November 15, 1997 <br />unused first use and return flows sufficient to replace depletions accruing during the 199711998 <br />winter storage season will be booked over to the undistributed winter storage account. A copy of the <br />agreement between AGUA and the Southeastern Colorado Water Conservancy District will be <br />forwarded to the Division Engineer's Office prior to March 31, 1997. <br /> <br />6.4 Replacement for Cuchares Ranches Wells <br /> <br />Three member wells (ID 1005287, 1005289 and 1005294) are tributary to Fountain Creek <br />but are not located within the Southeastern Colorado Water Conservancy District. Thus, Fry-Ark <br />Project water cannot be used to replace their depletions. Lagged depletions from these wells are <br />expected to total 15.5 acre-feet in 1997 (6.7 acre-feet due to 1996 plan year pumping plus 8.8 acre- <br />feet due to 1997 plan year pumping). AGUA will obtain at least 15.5 acre-feet of replacement water <br />for these wells from another Fountain Creek source. During the 1996 plan year the Cuchares <br />Ranches depletions were replaced using Gates Laughlin water obtained in a trade with the Colorado <br />Water Protective and Development Association (CWPDA). Prior to March 31,1997 AGUA will <br />forward to the Division Engineer's Office any agreement arrived at with CWPDA or others for <br />replacement water for the Cuchares Ranches wells. <br /> <br />6.5 Total Estimated Replacement Source Credits <br /> <br />Using average annual diversions and the credits described previously, AGUA's shares of the <br />Excelsior Ditch are expected to yield approximately 813 acre-feet of replacement credits during the <br />1997 plan year. Up to 4,500 acre-feet of transmountain water (assuming a ten percent transit loss <br />from Clear Creek Reservoir) will be available from the Board of Water Works of Pueblo. An <br />additional 50 acre-feet of Pueblo transmountain water is available by agreement with Owl Canyon <br />LLC. Total water available from Pueblo is 4,550 acre-feet. A total of 1,600 acre-feet of District <br />Fry-Ark first use and return flow water has been purchased for this year.
