<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />6.2 Board of Water Works of Pueblo Sources <br /> <br />AGUA has purchased a minimum of3,OOO acre-feet of trans mountain or otherwise fully <br />consumable water from Pueblo with the right to purchase an additional 2,000 acre-feet for a total of <br />up to 5,000 acre-feet. This water may be from any reusable sources owned by Pueblo including <br />direct flow transmountain imports (Busk-Ivanhoe, Wurtz, Columbine and Ewing), stored <br />transmountain water (the same sources reduced to storage in Pueblo, Clear Creek, Twin Lakes, or <br />Turquoise Reservoirs plus Twin Lakes water, and Homestake water), changed water rights decreed <br />for augmentation use including those of Pueblo's West Pueblo Ditch shares, and fully consumable <br />municipal return flow credits derived from the municipal use of any transmountain or otherwise fully <br />consumable waters. Water from Pueblo is available on a monthly basis as needed by AGUA. A <br />copy of the agreement between AGUA and Pueblo will be forwarded to the Division Engineer's <br />Office prior to March 31, 1997. If all of the Pueblo water were to come from Clear Creek Reservoir, <br />the transit loss of approximately 10 percent from high mountain storage to Pueblo would reduce the <br />replacement credits available to a minimum of2,700 acre-feet and up to 4,500 acre-feet. Transit <br />losses from the actual point of origin of the waters to Reach I will be used for determining the actual <br />replacement credits available from this source. <br /> <br />AGUA also has the right to utilize up to 50 acre-feet of trans mountain water leased from the <br />Board of Water Works of Pueblo by Owl Canyon LLC for the Chico Creek Dairy wells. Because <br />there will be less than 0.01 acre-feet of lagged replacement requirement for the dairy during the 1997 <br />plan year, AGUA will have the entire 50 acre-feet available for its replacements. <br /> <br />6.3 Southeastern Colorado Water Conservancy District Sources <br /> <br />AGUA has purchased Fryingpan-Arkansas Project first use and return flow water from the <br />District for use in this plan. AGUA has requested 1,000 acre-feet of known Fry-Ark return flows <br />from previous uses of Project water, and 600 acre-feet of Fry-Ark return flow water intended for use <br />replacing depletions to Fountain Creek. Known return flows will be used to replace depletions on <br />the Arkansas River below Pueblo Reservoir.
