<br />(e) The division of minerals and geology,
<br />created by section 34-20-103, C.R.S., the head of which
<br />shall be the director of the division of minerals and
<br />geology, under the supervision of the executive director
<br />of the department of natural resources. Said division
<br />and director shall exercise their powers, duties, and
<br />functions as prescribed by law under the department of
<br />natural resources and the executive director thereof as if
<br />the same were transferred to the department by a type 2
<br />transfer. The division of minerals and geology shall
<br />include the following:
<br />(I) The coal mine board of examiners, created
<br />by article 22 oftitle 34, C.R.S. Its powers, duties, and
<br />functions are transferred by a type 2 transfer to the
<br />department of natural resources as a section of the
<br />division of minerals and geology.
<br />(II) The mined land reclamation board and the
<br />office of mined land reclamation, created by article 32
<br />oftitle 34, C.R.S. The mined land reclamation board
<br />and its powers, duties, and functions are transferred by a
<br />type 1 transfer to the department of natural resources
<br />and allocated to the division of minerals and geology.
<br />The office of mined land reclamation shall exercise its
<br />powers, duties, and functions as if the same were
<br />transferred to the department of natural resources and
<br />allocated to the division of minerals and geology as a
<br />section thereofby a type 2 transfer.
<br />(III) The office of active and inactive mines,
<br />created by article 21 of title 34, C.R.S. Said office shall
<br />exercise its powers, duties, and functions as prescribed
<br />by law under the division of minerals and geology as if
<br />the same were transferred to the department of natural
<br />resources and allocated to the division of minerals and
<br />geology as a section thereof by a type 2 transfer.
<br />(IV) The Colorado geological survey and the
<br />office of the state geologist, created by part I of article 1
<br />of title 34, C.R.S. The Colorado geological survey and
<br />the office of the state geologist shall exercise their
<br />powers, duties, and functions as prescribed by law as if
<br />the same were transferred by a type 2 transfer to the
<br />department of natural resources and allocated to the
<br />division of minerals and geology as a section thereof.
<br />The relocation of the Colorado geological survey made
<br />by this subparagraph (IV) is subject to the provisions of
<br />section 34-20-103 (9), C.R.S.
<br />(V) The Colorado joint review process,
<br />created by article 10 oftitle 34, C.R.S. The Colorado
<br />joint review process shall exercise its powers and
<br />perfonn its duties and functions as prescribed by law as
<br />if the same were transferred by a type 2 transfer to the
<br />department of natural resources and allocated to the
<br />division ofrninerals and geology as a section thereof.
<br />(f) The oil and gas conservation commission
<br />of the state of Colorado and the office of the director
<br />thereof, created by article 60 oftitle 34, C.R.S. Said
<br />commission and office and the powers, duties, and
<br />functions thereof are transferred by a type 1 transfer to
<br />the department of natural resources as a division
<br />thereof.
<br />
<br />(g) (1) The Colorado geological survey and the
<br />office of the state geologist, created by part 1 of article 1
<br />oftitle 34, CR.S. Their powers, duties, and functions
<br />are transferred by a type 2 transfer to the department of
<br />natural resources as a division thereof.
<br />(II) The provisions of this paragraph (g) are
<br />subject to the provisions of section 34-20-103 (9),
<br />c.R.S., with respect to the location of the Colorado
<br />geological survey.
<br />(h) (I) (A) Division of wildlife, the head of
<br />which shall be the director of the division of wildlife.
<br />The division of wildlife and the office of director
<br />thereof are transferred by a type 2 transfer to the
<br />department of natural resources as the division of
<br />wildlife.
<br />(B) The wildlife commission, created by
<br />article 1 of title 33, CR.S., and the powers, duties, and
<br />functions thereof concerning game and fish are
<br />transferred by a type 1 transfer to the department of
<br />natural resources as the wildlife commission.
<br />(II) The division of wildlife shall include the
<br />fish health board created by article 5.5 of title 33, CR.S.
<br />The fish health board shall exercise its powers and
<br />perform its duties and functions as specified by law
<br />under the department of natural resources and the
<br />executive director thereof as if 1i1.e same were
<br />transferred to the department by a type 2 transfer.
<br />(III) (A) The captive wildlife and alternative
<br />livestock board, created in section 33-1-121, C.R.S.,
<br />shall exercise its powers and perform its duties and
<br />functions specified in this article under the department
<br />of natural resources and the executive director thereof as
<br />if the same were transferred to the department by a type
<br />2 transfer.
<br />(B) This subparagraph (III) is repealed,
<br />effective July 1, 2009.
<br />(i) (1) Division of parks and outdoor
<br />recreation, the head of which shall be the director of the
<br />division of parks and outdoor recreation. The division of
<br />parks and outdoor recreation, the office of director
<br />thereof, and the board of parks and outdoor recreation,
<br />created by article 10 of title 33, CR.S., are transferred
<br />by a type 1 transfer to the department of natural
<br />resources, The powers, duties, and functions
<br />concerning the state parks and recreation areas ofthe
<br />division of game, fish, and parks, the director thereof,
<br />and the game, fish, and parks commission are
<br />transferred by a type 1 transfer to the division of parks
<br />and outdoor recreation as powers, duties, and functions
<br />of the division of parks and outdoor recreation.
<br />(II) The board of parks and outdoor recreation
<br />shall include, as an advisory council, the Colorado
<br />natural areas council, created by article 33 oftitle 33,
<br />eR.S.
<br />U) The division offorestry, created in section
<br />24-33- 201 (1), the head of which shall be the state
<br />forester, appointed pursuant to section 23-30-207,
<br />C.R.S., and the forestry advisory board, created in
<br />section 24-33-202 (1). The division offorestry, the
<br />state forester, and forestry advisory board shall exercise
