Department of natural resources - creation - <br />divisions - repeal. (1) There is hereby created a <br />department of natural resources, the head of which shall <br />be the executive director of the department of natural <br />resources, who shall be the commissioner of mines. <br />The executive director shall be appointed by the <br />governor pursuant to law. <br />(2) The office of natural resources coordinator, <br />created by article 33 of this title, and its powers, duties, <br />and functions are transferred by a type 2 transfer to the <br />department of natural resources. <br />(2.1) The department of natural resources shall <br />include, as a part of the office of the executive director: <br />(a) The office of commissioner of mines, <br />created by section 1 of article XVI of the state <br />constitution. Its powers, duties, and functions are <br />transferred by a type 2 transfer to the office of the <br />executive director of the department of natural <br />resources. <br />(b) (Deleted by amendment, 1. 92, p. 1917, S <br />2, effective July 1, 1992.) <br />(3) The department of natural resources shall <br />consist of the following divisions: <br />(a) Division of water resources, the head of <br />which shall be the state engineer; <br />(b) The Colorado water conservation board <br />and the office of director thereof, created by aliicle 60 <br />oftitle 37, C.R.S. Their powers, duties, and functions <br />are transferred by a type 1 transfer to the department of <br />natural resources as a division thereof. <br />(c) (Deleted by amendment, 1. 2000, p. 556, S <br />3, effective July 1, 2000.) <br />(d) The state board of land commissioners, <br />created by section 9 of article IX of the state <br />constitution. Its powers, duties, and functions are <br />transferred by a type 1 transfer to the department of <br />natural resources as a division thereof, subject to the <br />state constitution. <br /> <br />2 <br />
