24-1-124. Department of natural resources - creation -
divisions - repeal. (1) There is hereby created a
department of natural resources, the head of which shall
be the executive director of the department of natural
resources, who shall be the commissioner of mines.
The executive director shall be appointed by the
governor pursuant to law.
(2) The office of natural resources coordinator,
created by article 33 of this title, and its powers, duties,
and functions are transferred by a type 2 transfer to the
department of natural resources.
(2.1) The department of natural resources shall
include, as a part of the office of the executive director:
(a) The office of commissioner of mines,
created by section 1 of article XVI of the state
constitution. Its powers, duties, and functions are
transferred by a type 2 transfer to the office of the
executive director of the department of natural
resources.
(b) (Deleted by amendment, 1. 92, p. 1917, S
2, effective July 1, 1992.)
(3) The department of natural resources shall
consist of the following divisions:
(a) Division of water resources, the head of
which shall be the state engineer;
(b) The Colorado water conservation board
and the office of director thereof, created by aliicle 60
oftitle 37, C.R.S. Their powers, duties, and functions
are transferred by a type 1 transfer to the department of
natural resources as a division thereof.
(c) (Deleted by amendment, 1. 2000, p. 556, S
3, effective July 1, 2000.)
(d) The state board of land commissioners,
created by section 9 of article IX of the state
constitution. Its powers, duties, and functions are
transferred by a type 1 transfer to the department of
natural resources as a division thereof, subject to the
state constitution.
