<br />their powers, duties, and functions as prescribed by law
<br />under the department of natural resources and the
<br />executive director thereof as if the same were
<br />transferred to the department by a type 2 transfer.
<br />(4) The division of water resources shall
<br />include the following:
<br />(a) The office of state engineer, created by
<br />article 80 of title 37, C.R.S. Said office and its powers,
<br />duties, and functions are transferred by a type 1 transfer
<br />to the department of natural resources and allocated to
<br />the division of water resources as a section thereof.
<br />(b) The division engineers, created by part 2 of
<br />article 92 of title 37, C.R.S. Said engineers and their
<br />powers, duties, and functions are transferred by a type 1
<br />transfer to the department of natural resources and
<br />allocated to the division of water resources as a section
<br />thereof.
<br />(c) The ground water commission, created by
<br />article 90 oftide 37, C.R.S. Said commission and its
<br />powers, duties, and functions are transferred by a type 1
<br />transfer to the department of natural resources and
<br />allocated to the division of water resources as a section
<br />thereof.
<br />(d) The state board of examiners of water well
<br />construction and pump installation contractors, created
<br />by article 91 of title 37, c.R.S. Said board and its
<br />powers, duties, and functions are transferred by a type 1
<br />transfer to the department of natural resources and
<br />allocated to the division of water resources as a section
<br />thereof.
<br />
<br />(e) Repealed.
<br />(5) Repealed.

<br />24-1-129. Effect of transfer of powers, duties, and
<br />functions. Any principal department to which powers,
<br />duties, and functions of any existing department,
<br />institution, or other agency are transferred or any
<br />division, section, or unit of any principal department to
<br />which such powers, duties, and functions are allocated
<br />shall be the successor in every way with respect to such
<br />powers, duties, and functions of the department,
<br />institution, or other agency in which such powers,
<br />duties, and functions were vested prior to July 1, 1968,
<br />except as otherwise provided by this article. Every act
<br />performed in the exercise of such powers, duties, and
<br />functions by or under the authority of the principal
<br />department or any division, section, or unit thereof to
<br />which such powers, duties, and functions are transferred
<br />or allocated by this article shall be deemed to have the
<br />same force and effect as if performed by the department,
<br />institution, or other agency in which such functions
<br />were vested prior to July 1, 1968. When any such
<br />department, institution, or other agency is referred to or
<br />designated by any law, contract, or other document,
<br />such reference or designation shall be deemed to apply
<br />to the principal department or the division, section, or
<br />unit thereof in which the powers, duties, and functions
<br />of such department, institution, or other agency so
<br />
<br />referred to or designated are vested by the provisions of
<br />this article.
