<br />, <br /> <br />. <br /> <br />RTMENT OR AGENCY NUMBER <br />P0A <br />CONTRACT ROUTING NUMBER <br />Ol()("n <br /> <br />CONTRACT <br /> <br />THIS CONTRACT, made this 12th day of ~ 1997, by and between the State of Colorado for the use and benefit of the Department of Natural <br />Resources. Colorado Water Conservation Board. 1313 Shennan St. Room 721. Denver. Colorado 80203 hereinafter referred to as the State, and the Cherry Creek <br />Valley Water and Sanitation District. 8501 East Iliff Avenue. Denver. Colorado 80231. hereinafter referred to as the Contractor. <br /> <br />WHEREAS, authority exists in the Law and Funds have been b)l2Bsted, appropriated and otherwise made available and a sufficient unencumbered <br />balance there of remains available for payment in Agency PDA, Fund Numbe~-brganization 92YY, Appropriation Code 100, Program WIRe, Object Code <br />5110, Sub Object Code 03, Contract Encumbrance NumberC\~?J lll:, ; and <br /> <br />WHEREAS, required approval, clearance and coordination has been accomplished from and with appropriate agencies; and <br /> <br />WHEREAS, the State desires to assist public agencies, established under Colorado law, for the purpose of a pilot program demonstrating the benefits <br />of water efficiency measures by providing incentive grants pursuant to the authority granted in Section 37-60.125, CRS; and <br /> <br />WHEREAS, the Contractor's application for a grant from the Water Conservation Board Construction Fund has been received and approved by the <br />Colorado Water Conservation Board; and <br /> <br />WHEREAS, the Colorado Water Conservation Board desires to distribute said funds pursuant to law; and <br /> <br />WHEREAS, the Contractor is a public agency eligible to receive grant assistance from the Pilot Program for demonstrating the benefits of water <br />efficiency measures. <br /> <br />NOW THEREFORE it is hereby agreed that <br /> <br />1. Scone of Services. In consideration for the moneys to be received from the State, the Contractor shall do, perform, and carry out, in a satisfactory <br />and proper manner, as detenruned by the State, all work elements and services as set forth in the attached Exhibit A, "Scope of Services", hereinafter referred to as <br />the "Project" and incorporated herein. Work performed prior to the execution of this Contract shall not be considered part of this Project. <br /> <br />2. Resnonsible Administrator. The perfonnance of the services required hereunder shall be under the direct supervision of John Warford, an <br />employee or agent of Contractor, who is hereby designated as the administrator-in-charge of this Project. If At any time the administrator-in-charge changes the <br />Board must be given written notice of the change and must approve the replacement before any further moneys are distributed. <br /> <br />3. Time of Performance. This Contract shall become effective upon proper execution of this Contract by the State Controller or his designee. The <br />Project contemplated herein shall commence as soon as practicable after the execution of this Contract and shall be undertaken and performed in the sequence set <br />forth in the "Time ofPerfoll1lance" in the attached ExhibitA. Expenses incurred by the Contractor in association with said Project prior to execution of this Contract <br />shall not be eligible expenditures. The Contractor agrees that time is of the essence in the performance of its obligations under this Contract, and that completion of <br />the Project shall occur no later than the termination date set forth in the Time ofPerfoll1lance in Exhibit A. <br /> <br />4. Comoensation and Method of Payment. The State agrees to pay to the Contractor, in consideration for the work and services to be performed, a <br />total amount not to exceed FOUR THOUSAND TWO HUNDRED AND TWENTY -FIVE AND NO/I 00 Dollars ( $4.225 ). The method and time of payment shall <br />be made in accordance with the "Payment Schedule" set forth in Exhibit A. <br /> <br />Page 1 of 6 Pages <br />
