09CW01 <br /> RULING <br /> The conditional water rights decreed to the structures identified above for mining, <br /> milling, domestic, industrial,power generation, and mill slurry conveyance purposes are <br /> HEREBY CONTINUED, in full force and effect. To the extent the points of diversion decreed <br /> herein are on lands belonging to the United States, Applicant must show that there are no legal <br /> impediments to acquisition of the right to transport the water across federal lands. The Court <br /> fords that it is likely that Applicant will gain such rights, and so this finding of diligence is <br /> appropriate. The entry of this decree gives Applicant no authority to do any activity on federal <br /> lands which would require federal approval. Approvals must be obtained from the Forest Service <br /> before Applicant may survey for or construct any of the proposed water system. The conditional <br /> rights continued herein may not be made absolute until such approval is demonstrated to the <br /> Court. <br /> Prior to or during the month of June, 2015, and every six years thereafter until the <br /> conditional right is decreed absolutely,the owner or user thereof, if it is desired to maintain the <br /> same, shall file an application for fording of reasonable diligence with this Court_ Applicant <br /> shall notify this Court of any change in mailing address. Upon the sale or other transfer of this <br /> conditional right, the transferee shall file with this Court a notice of transfer which shall state: <br /> 1. The title and case number of this case; <br /> 2. The description of the water right transferred; <br /> 3. The name of the transferor; <br /> 4. The name and mailing address of the transferee <br /> Applicant shall notify any transferee of the requirements of this paragraph. <br /> Dated this 25th day of November, 2015.
