A LOCAL PLANNING <br /> <br />JURISDICTION MAY PERMIT LIMITED DEVELOPMENT IN ANY SUCH RURAL <br /> <br />DEVELOPMENT AREA IF THE PROPOSED DEVELOPMENT IS COMPATIBLE WITH <br /> <br />THE LAND USE DESIGNATED FOR THAT AREA IN THEJURlSDICTION's MASTER <br /> <br />PLAN, IF THE DEVELOPMENT WILL NOT RESULT IN URBAN GROWTH. AND IF <br /> <br />THE PROPOSED DEVELOPMENT IS: <br /> <br />(I) A RESIDENTIAL DEVELOPMENT WITH AN AVERAGE DENSITY NO <br />GREATER THAN THE CAPACITY OF THE LAND TO SUPPORT THE PROPOSED <br /> <br />WATER AND W ASTEW A TER PROVISIONS WHERE: <br /> <br />(A) THE DEVELOPMENT IS COMPACT AND CLUSTERED IN <br /> <br />ACCORDANCE WITH THE REOUIREMENTS OF SECTION 30-28-403, C.R.S.; <br /> <br />AND <br /> <br />(B) THE DEVELOPMENT SATISFIES ALL APPLICABLE FEDERAL, <br /> <br />STATE, OR LOCAL LAWS AND REGULATIONS, INCLUDING SUBDIVISION <br /> <br />REGULATIONS. <br /> <br />(ll) SUCH COMMERCIAL DEVELOPMENT ASMA Y BE NECESSARY AND <br /> <br />APPROPRIATE TO SERVE THE RESIDENTIAL DEVELOPMENT AREA AND THAT <br /> <br />SATISFIES ALL APPLICABLE FEDERAL, STATE. OR LOCAL LAWS AND <br /> <br />REGULATIONS, INCLUDING SUBDIVISION REGULATIONS; OR <br />(III) A PUBLIC FACILITY NECESSARY FOR THE PUBLIC HEALTH. <br /> <br />~AFETY, OR WELFARE, INCLUDING, WITHOUT LIMITATION.
