A LOCAL PLANNING JURISDICTION SHALL NOT APPROVE ANY <br /> <br />DEVELOPMENT APPLICATION WITHIN A RURAL DEVELOPMENT AREA UNLESS <br /> <br />SUCH APPLICATION IS APPROVED IN ACCORDANCE WITH AN ADOPTED <br /> <br />TRANSFERRABLE DEVELOPMENT RIGHTS PROGRAM THE EXPRESS PURPOSE <br /> <br />OF WHICH IS TO PROTECT RURAL LAND FROM DEVELOPMENT. <br /> <br />(d) IN CONNECTION WITH THE CREATION OF ANY LOT LESS THAN <br /> <br />THIRTY-FIVE ACRES IN SIZE. THE LANDOWNER SHALL ARRANGE FOR THE <br /> <br />PURCHASE OF TRANSFERABLE DEVELOPMENT RIGHTS PURSUANT TO A <br /> <br />TRANSFERABLE DEVELOPMENT RIGHTS PROGRAM ESTABLISHED BY THE <br /> <br />LOCAL PLANNING JURISDICTION PURSUANT TO SUBSECTION (9) OF THIS <br /> <br />SECTION SUCH THA TTHE TOTAL ACREAGE OF THE LOT SIZE COMBINED WITH <br /> <br />THE ACREAGE OF THE LAND FROM WHICH THE TRANSFERABLE <br /> <br />DEVELOPMENT RIGHTS ARE PURCHASED IS EQUAL TO THIRTY-FIVE. <br /> <br />(3) (a) A LOCAL PLANNING JURISDICTION MAY DESIGNATE LANDS <br /> <br />IT HAS DESIGNATED AS RURAL LANDS AS RURAL DEVELOPMENT AREAS SO <br /> <br />LONG AS THE DESIGNATION OF THESE AREAS SHALL NOT RESULT IN THE <br /> <br />DEVELOPMENT OF CRITICAL AND SENSITIVE AREAS OR CRITICAL WILDLIFE <br /> <br />HABITATS IN ACCORDANCE WITH APPLICABLE FEDERAL. STATE. OR LOCAL <br />LAW. THE RURAL DEVELOPMENT AREA SHALL BE NO GREATER THAN AN <br /> <br />AMOUNT OF LAND NEEDED FOR RURAL RESIDENTIAL AND SUPPORTING <br /> <br />NONRESIDENTIAL DEVELOPMENT. GIVEN PROJECTIONS OF POPULATION AND <br />JOB GROWTH. PROJECTED DENSITY. AND THE JURISDICTIONS FINANCIAL <br /> <br />ABILITY TO PROVIDE AND MAINTAIN AN ADEQUATE LEVEL OF SERVICES FOR <br />THE SUCCEEDING TWENTY-YEAR PERIOD.
