(b) For the purposes of this subsection (2), "renewable

energy source property" means

centralized or decentralized
,

heating and cooling and decentralized electrical generation

works and distribution systems for the distribution of heat,

cooling,

and electrical power obtained from geothermal

resources, solar and photovoltaic energy, wind energy, or
hydroelectric or renewable biomass resources, including waste

and cogenerated heat, but excepting centralized electric light

or gas systems or plants, and water and sewer treatment

systems, facilities, and distribution lines.

SECTION 3. 31-32-105, Colorado Revised Statutes, 1977
Repl. Vol., as amended, is amended to read:
31-32-105. Cities or towns may erect utilities. Nothing

17 in this part 1 shall be construed as in any way modifying or
18 restricting the right of cities or towns to purchase or erect
19 eie~tri~--iight--works,--heating---and---~ooiing---works---and
20 distrib~tion--systems-for-the-distrib~tion-of-heat-and-eooting
21 obtained-from-geothermai--reso~rees,--soiar--or--wind--energy,

22 hydroeie~tri~--or-renewabie-biomass-resottr~es,-inet~ding-waste

23 and-~ogenerated-heat,-or-gasworks UTILITY WORKS OR SYSTEMS in

24 the manner provided for by law.
