Customers of <br /> the District whose property is hereafter annexed to the Town will <br /> pay in-Town water rates from and after the effective date of such <br /> annexation. The out-of-Town water rate charged to customers whose <br /> property is located within the boundaries of the District as of <br /> the date of this Agreement will never exceed one and one-half <br /> (1.5) times the in-Town water rate. <br /> 6.2 Determination of Single Family Equivalents--Water Fees. <br /> The Town and the District acknowledge that the Town's base water <br /> fees are currently calculated on the basis of the number of Single <br /> Family Equivalents (SFEs) assigned to the property receiving such <br /> water service as currently set forth in Section 12-2-21-4 of the <br /> Breckenridge Town Code. For a period of five (5) years following <br /> the effective date of the dissolution of the District the Town <br /> will calculate the base water fee for properties located within <br /> the boundaries of the former District by using the number of SFEs <br /> assigned to such properties by the District as of the date of this <br /> Agreement. Following such five (5) year period, the number of <br /> SEEs assigned to properties located within the boundaries of the <br /> former District will be determined by applicable Town Ordinances <br /> in effect from time to time. <br /> 7. Tan Fees. <br /> 7.1 Payment of Town Plant Investment Fees. Following <br /> dissolution of the District, a customer whose property is located <br /> within both the boundaries of the former District and the <br /> • <br /> corporate boundaries of the Town as of the date of connection to <br /> the Town's municipal water system will pay to the Town a tap fee <br /> to connect to the Town's municipal water system (called "Plant <br /> Investment .Fee" under Town Ordinances) at the Town's in-Town rate <br /> as determined by applicable Town Ordinances in effect on the date <br /> such connection is made. For a period of five (5) years from and <br /> after the effective date of the dissolution of the District, a <br /> customer tapping into the system or expanding an existing use <br /> whose property is located within the boundaries of the former <br /> District but outside the corporate boundaries of the Town as of <br /> the date of connection to the Town's municipal water system will <br /> pay to the Town Plant Investment Fees of Three Thousand Dollars <br /> ($3,000.00) per SFE for new construction, such rate being the <br /> District's tap fee rate which was in effect at the time of <br /> • <br /> dissolution. Following such five (5) year period, any such <br /> customer tapping or expanding a use will pay to the Town a Plant <br /> Investment Fee to connect to the Town's municipal water system at <br /> the Town's out-of-Town rate. The out-of-Town Plant Investment Fee <br /> charged by the Town for property located within the boundaries of <br /> 4 <br />
