r • . <br /> • <br /> therefore. The Town will assume and accept the same, subject to <br /> the terms"and provisions of such contractual obligations. A list <br /> of the contracts to which the District is a party is marked <br /> Exhibit "A", attached hereto and incorporated herein by reference. <br /> The District will further delegate and assign to the Town all of <br /> the District's rights and obligations to provide services and the <br /> District's right and entitlement to receive from customers of the <br /> District all outstanding amounts due and payable. The Town will <br /> assume and accept the same. Should some significant obligation of <br /> the District of which the parties are not currently aware become <br /> known within five (5) years of the date of the dissolution of the <br /> District, the Town shall have the right to petition the Court, <br /> following notice to property owners of the District at the time of <br /> dissolution, for authority to assess the cost of such obligation <br /> to the property within the District at the time of dissolution. <br /> 4. Continuation of Service By Town. The Town will <br /> incorporate the operations of the District into its municipal <br /> water system. In connection therewith, the Town will provide <br /> water service to real property located within the boundaries of <br /> the District which is consistent with the operations of the Town's <br /> water system within the corporate boundaries of the Town. Future <br /> capital improvements and system upgrades to the former District's <br /> water system will be made by the Town on the same basis as the <br /> Town uses in making such upgrades or improvements to its in-Town <br /> water system. Notwithstanding anything contained herein to the <br /> contrary, however, it is understood and agreed that the Town plans <br /> to discontinue the operation of the District's Warrior's Mark <br /> Treatment plant and to serve that geographic area through the <br /> Town's existing water distribution , facilities located in that <br /> area. Further, the Town will have two years following the date of <br /> dissolution of the District within which to interconnect to the <br /> District's Peak 7/Silver Shekel system. <br /> • <br /> 5. Availability of Future Water Service. The Town will <br /> continue the services of the District by making available treated <br /> water from its municipal water system to all property which is <br /> located within the boundaries of the District as of the date of <br /> this Agreement. To the extent that a portion of the property <br /> located within the District is also located outside of the <br /> corporate boundaries of the Town, this Agreement will constitute a <br /> contract to provide out-of-town water service within the meaning <br /> of Section 12-3-3 of the Breckenridge Town Code. <br /> 6. Water Rates. <br /> • <br /> 6.1 In-Town and Out-of Town Water Rates. Customers of the <br /> District whose property is located within both the boundaries of <br /> the District and the corporate boundaries of the Town as of the <br /> date of this Agreement will pay for water service received from <br /> the Town at the Town's in-Town water rate.
