r • <br /> the former District as of the date of this Agreement will never <br /> exceed two" (2.0) times the in-Town rate. <br /> 7.2 Determination of Single Family Equivalents--Plant <br /> .Investment Fees. The Town and the District acknowledge that the <br /> Town's Plant Investment Fee is currently calculated on the basis <br /> of the number of Single Family Equivalents (SFEs) assigned to the <br /> property being connected to the Town's municipal water system, as <br /> currently set forth in Section 12-2-21-4 of the Breckenridge Town <br /> Code. For a period of five (5) years following the effective date <br /> of the dissolution of the District the Town will calculate the <br /> Town's Plant Investment Fee for properties located within the <br /> boundaries of the former District by using the number of SFEs <br /> assigned to such properties by the District as of the date of this <br /> Agreement. Following such five (5) year period, the number of <br /> SFEs assigned to properties located within the boundaries of the <br /> former District will be determined by applicable Town Ordinances <br /> in effect from time to time. <br /> 7.3 District's Pre-Paid Tap Fees. The Town will honor all <br /> pre-paid tap fees received by the District prior to the date of <br /> this Agreement, and will not require the payment of additional <br /> fees or charges for the same level of water service. For example, <br /> one of the District's pre-paid water taps for one Single Family <br /> Equivalent will be treated as a paid Plant Investment Fee for one <br /> Single Family Equivalent under applicable Town Ordinances. A <br /> complete list of the District's pre-paid tap fees is marked <br /> Exhibit "B", attached hereto and incorporated herein by reference. <br /> 8. Town Regulations. From .and after the date of the <br /> dissolution of the District customers whose property is located <br /> within the boundaries of the former District will be bound by the <br /> Town's ordinances, rules and regulations pertaining to the <br /> operation of the Town's municipal water system in effect from time <br /> to time to the extent such ordinances, rules and regulations are <br /> not inconsistent with the terms of this Agreement. Such <br /> regulations which are applicable to the former District will be <br /> substantially the same as are applicable to in-Town customers of <br /> the Town's municipal water system. <br /> 9. Provision For Bonded Indebtedness. Exhibit "C", which is <br /> attached hereto and incorporated herein by reference, is a true <br /> and correct schedule of the District's future debt service. Such <br /> debt will be paid by the Town as hereafter provided in this <br /> Paragraph 9. None of such debt is in default as of the date of <br /> this Agreement. <br /> 9.1 .I990 General Obligation Bonds. The District's 1990 <br /> General Obligation Bonds ("Bonds") are callable on December 1, <br /> 1995.
