1 1998, AND ON JUNE 30,1999, THE STATE TREASURER SHALL DEDUCT ONE <br />2 MILLION TWO HUNDRED THOUSAND DOLLARS FROM THE DRINKING WATER <br />3 REVOLVING FUND AND TRANSFER SUCH SUM TO THE CAPITAL ACCOUNT OF <br />4 THE SPECIES CONSERVATION TRUST FUND CREATED IN SECTION 24 -33 -111 <br />5 (2), C.R.S. <br />6 SECTION 3. 37-60 -121; Colorado Revised Statutes, is amended <br />7 BY THE ADDITION OF A NEW SUBSECTION to read: <br />8 37 -60 -121. Colorado water conservation board construction <br />9 fund - creation of - nature of fund - funds for investigations - <br />10 contributions - use for augmenting the general fund. <br />11 (8) NOTWITHSTANDING ANY PROVISION IN THIS SECTION OR SECTION <br />12 37 -60 -122 TO THE CONTRARY, THE STATE TREASURER SHALL DEDUCT FIVE <br />13 HUNDRED THOUSAND DOLLARS FROM THE COLORADO WATER <br />14 CONSERVATION BOARD CONSTRUCTION FUND AND TRANSFER SUCH SUM TO <br />15 THE CAPITAL ACCOUNT OF THE SPECIES CONSERVATION TRUST FUND <br />16 CREATED IN SECTION 24- 33- 111(2), C.R.S. <br />17 SECTION 4. 37 -60- 121.1(2), Colorado Revised Statutes, <br />18 is amended to read: <br />19 37- 60- 121.1. Reserved rights litigation fund. (2) (a) There is <br />20 hereby established a reserved rights litigation fund in the office of the <br />21 state treasurer to be utilized by the department of law for resolution of <br />22 reserved rights claims. Moneys credited to said fund shall be expended <br />23 by the attorney general only upon authorization by the general assembly <br />24 and consistent with the provisions of this section. The controller, upon <br />25 presentation of vouchers properly drawn and signed by the attorney <br />26 general or an authorized employee of the department of law, shall issue <br />27 warrants drawn on said fund. All moneys so deposited in the reserved <br />28 rights litigation fund shall remain in said fund to be used for the purposes <br />29 set forth in this section and shall not revert to the Colorado water <br />30 conservation board construction fund, the general fund, or any other fund <br />31 at the end of the year, except as directed by the general assembly. All <br />32 interest earned from the investment of moneys in the reserved rights <br />33 litigation fund shall be credited to and become a part of the Colorado <br />34 water conservation board construction fund created by section 37 -60 -121. <br />35 (b) NOTWITHSTANDING ANY PROVISION OF PARAGRAPH (a) OF THIS <br />36 SUBSECTION (2) TO THE CONTRARY, ON JULY 1, 1998, THE STATE <br />-2- <br />
