After consideration on the merits, the Committee recommends the
following:
HB 98 -1006 be amended as follows, and as so amended, be referred to
the Committee of the Whole with favorable
recommendation:
1 Amend reengrossed bill, page 2, line 14, strike "SPECIES." and substitute
2 "SPECIES FOR COMPLYING WITH THE "FEDERAL MANDATES ACT ", ARTICLE
3 78 OF THIS TITLE, AND FOR NEGOTIATING AGREEMENTS WITH FEDERAL
4 AGENCIES AND OTHER STATES TO AVOID REGULATORY CONFLICTS
5 PURSUANT TO SECTION 24 -33- 103. ";
6 line 18, after the period, insert the following:
7 "THERE IS HEREBY CREATED WITHIN THE SPECIES CONSERVATION TRUST
8 FUND THE OPERATION AND MAINTENANCE ACCOUNT AND THE CAPITAL
9 ACCOUNT. THE MONEYS IN THE OPERATION AND MAINTENANCE ACCOUNT
10 SHALL BE FOR ADMINISTRATIVE AND NONCAPITAL EXPENDITURES
11 NECESSARY FOR THE IMPLEMENTATION OF THIS SECTION. THE MONEYS IN
12 THE CAPITAL ACCOUNT SHALL BE USED EXCLUSIVELY FOR CAPITAL
13 EXPENDITURES INCLUDING BUT NOT LIMITED TO PROPERTY ACQUISITION
14 AND PROJECT CONSTRUCTION. ".

16 "SECTION 2. 37 -95 -107.8 (4), Colorado Revised Statutes, is
17 amended BY THE ADDITION OF A NEW PARAGRAPH to read:
18 37 -95- 107.8. Creation and administration of drinking water
19 revolving fund. (4) (d) NOTWITHSTANDING ANY PROVISION OF
20 PARAGRAPH (C) OF THIS SUBSECTION (4) TO THE CONTRARY, ON JUNE 30,
