Barnett, Executive Director <br /> SUBJECT: SALINITY LEGISLATION <br /> DATE: January 14, 1983 <br /> On December 30, 1982, by MEMORANDUM 82-104, the Forum and Work Group. <br /> members were provided with the Administration's positions concerning S. 2202. <br /> I have since discussed several points made by the Administration with some <br /> members of the Work Group and the Forum. I intend to discuss the impacts of <br /> the requested changes further with basin states and federal officials over the <br /> next week. Myron Holburt plans a trip to Salt Lake City on Monday, January 17, <br /> and we will be discussing these requested changes and the possible need for <br /> Work Group attention to some of these matters. , <br /> Following is a rather lengthy and somewhat detailed analysis of the <br /> Administration's requested changes to the legislation. Let me first summarize <br /> my conclusions. I believe there are only four major issues which may require <br /> Forum policy. They are: <br /> 1. Cost sharing - paragraph 11 below <br /> 2. Authorization of salinity units before feasibility studies <br /> are completed - paragraph 2 below <br /> 3. Authority the governors and Advisory Council may be given <br /> to review the ongoing programs without encroaching upon <br /> the powers given to the federal government by the <br /> Constitution - paragraph 8 below <br /> 4. Requirement that a ceiling be imposed in the expenditure <br /> • <br /> of funds for the Department of Agriculture - paragraph <br /> 9 below <br /> I believe it would be to the Forum's advantage to have the legislation <br /> introduced as quickly as possible, exactly as it was prepared last year, and <br /> then allow the Forum to address its position on various changes to the leg- <br /> islation prior to hearings. I have felt this was the general feeling of the <br /> Forum. Chairman Christopulos has requested that I call a Forum member from <br /> each state to see if they concur in this approach. After the introduction of <br /> the legislation, I recommend that a special short Forum meeting be held at some <br /> convenient location to resolve the Forum positions on these four issues. <br />
