MEMORANDUM 83-2 -2- • January 14, 1983 <br /> For convenience, I will address the changes by the page numbers in S. <br /> 2202. <br /> 1. On page 2, the Department of the Interior proposes some words be added <br /> with respect to the Principles, Standards, and Procedures. These words <br /> serve to further clarify the intent of the legislation and I believe the <br /> Administration's support of the Forum's position in this regard is a ' <br /> welcome support and should be accepted. <br /> 2. The Department of the Interior proposes to delete all of page 3 of the <br /> legislation and all of page 4 down to line 14. The Department of the <br /> Interior would insert a paragraph which would authorize the feasibility <br /> investigation of the Saline Water Use and Disposal Opportunity unit. <br /> Feasibility authorization is needed for this unit as in mid next year the <br /> effort that Mike Clinton is heading up will run out of authority unless <br /> the Congress acts to authorize feasibility investigations. The Forum <br /> legislation or other legislation which will move through Congress quickly <br /> is needed to authorize this unit. With respect to the requested deletions, <br /> the .Department requests these because they are in opposition to authoriza- <br /> tion of the six additional units the Forum has requested before feasibility <br /> studies have been completed. Enclosed you will find a copy of the letter <br /> I have written to the Bureau of Reclamation asking them to assess the <br /> impact of these deletions on the timing of the potential implementation of <br /> each of these units. I believe the deletions requested by the Department <br /> of the Interior are important amendments for the Forum to consider. <br /> Perhaps they can only be resolved by Forum policy at a Forum meeting. <br /> r <br /> 3. On page 5, the Department of the Interior requests a change in the <br /> language on line 21, 22, and the start of 23, to clarify the prohibition <br /> in the legislation with respect to assuming long term commitments for <br /> operation and maintenance of certain facilities. I believe the requested <br /> language change is acceptable. <br /> 4. On page 6, the Department of the Interior requests two words be <br /> removed from line 11 because it clarifies the legislation and I concur. <br /> 5. On page 7, the Department of the Interior requests the deletion of <br /> lines 15 through 23. This language is not necessary in the legislation if <br /> you delete the authorization of the six new units that the Forum has <br /> requested. This requested deletion also addresses the question of whether <br /> or not the veto provisions by the states is constitutional. This is an <br /> important point for the Forum to consider and it is further addressed • <br /> under item 8 below. <br /> 6. On page 8, the Department of Agriculture requests that the word <br /> 'private' .be stricken from line 6 and at the bottom of the page in the <br /> last two lines all the words be removed after the word 'values'. These <br /> are editorial changes intended for clarity and I anticipate that the Forum <br /> could accept those changes. <br /> 7. On page 9, line 13, the Department of Agriculture requests that some <br /> additional words be added to clarify the intent of this paragraph. I <br /> believe these are constructive changes and the Forum should concur. <br /> • <br />
